Preliminary hearing set for agent in border death

A May 17th preliminary court hearing was set today for a southern Arizona Border Patrol agent facing criminal prosecution in the fatal January shooting of an illegal immigrant from Mexico.


The justice court hearing in Douglas will determine whether there's probable cause to try agent Nicholas Corbett. A criminal complaint filed this week by the Cochise County Attorney's Office lists charges of first-degree murder, second-degree murder, manslaughter and negligent homicide.


Judge Alma Vildosola will decide at the May hearing whether there's enough evidence to transfer the case to superior court for trial -- and on what charges.


Corbett -- who remains free without bail -- told colleagues that he shot the man because it appeared he was going to throw a rock. But witnesses told investigators Corbett fired while pushing the victim to the ground.
