City teen guilty of sexually assaulting 8-year-old

A Sheboygan teen was convicted today of sexually assaulting an 8-year-old girl after reaching a plea agreement under which prosecutors will recommend he serve eight years in prison, said Sheboygan County District Attorney Joe DeCecco.

Martin L. Gamez, of 1212 Erie Ave., a Mexican citizen in the United States illegally, was stabbed by the girl’s mother several minutes after a family friend of the victim stopped the assault, according to a criminal complaint. The friend discovered Gamez in the early morning hours Aug. 16 masturbating behind the girl, who was kneeling on a bed naked from the waist down in her’ mother’s north-side apartment, the complaint said.

Gamez pleaded no contest today to a count of felony first-degree sexual assault of a child as part of a plea deal that dismissed a misdemeanor count of exposing genitals to a child, DeCecco said.

Gamez will be sentenced June 6 on the felony, which carries a penalty of up to 40 years in prison. He will also be sentenced that day on a count of second-degree sexual assault in a separate case, for forcing himself on a teenage girl in November 2006, court records show.

Gamez was initially given a deferred conviction agreement in that case — meaning the charge would be dismissed if he committed no further crimes for three years — but that agreement was revoked after the new charges were filed.

He faces up to 25 years in prison on the older charge. Judge Timothy Van Akkeren will hand down the sentences in both cases.

Gamez will remain in jail without bond until his sentencing.

The mother who stabbed Gamez was charged with misdemeanor battery for the assault but entered a deferred conviction agreement under which the charge will be dismissed if she commits no further crimes for one year and performs 50 hours of community service.
