    PA - Illegal immigrant sentenced in fatal Chambersburg crash

    CHAMBERSBURG, Pa. —

    An illegal immigrant who killed two people in a car crash while his deportation was reportedly on hold is headed to state prison for eight years.

    As part of a plea agreement, Agustin Macias-Marquez, 28, formerly of Waynesboro, Pa., admitted he consumed enough beer to reach .14 blood-alcohol content, drove a car without a license, ran a stop sign and caused a two-vehicle accident that claimed two lives.

    The broadside collision occurred Dec. 31, 2012, in Chambersburg.

    The families of victims Heather Coble and Madison J. Perry listened as Franklin County (Pa.) Court of Common Pleas Judge Carol Van Horn sentenced the defendant Wednesday.

    U.S. Immigration and Customs Enforcement has a detainer for Macias-Marquez and will likely deport him when he is scheduled to be released from prison, according to statements from the judge and attorneys.

    Court-appointed defense attorney Chris Reibsome told the judge about a discussion he had with Macias-Marquez about an earlier effort to deport him.

    Macias-Marquez said he was in the process of being deported after a 2011 driving-under-the-influence case, according to Reibsome. But Macias-Marquez claimed the Franklin County District Attorney’s Office put a hold on that deportation because it wanted him to testify in court about a homicide he witnessed on Oct. 22, 2012.

    Reibsome cautioned he did not verify the accuracy of his client’s statements.

    Franklin County District Attorney Matt Fogal did not respond to a request for comment before deadline Wednesday. It was unclear which country held the ICE detainer.

    Coble’s family showed a reporter pictures of the Saturn car in which Coble and Perry were passengers. It was being driven by Nicholas Fortenberry at the intersection of McKinley Street and Cleveland Avenue in Chambersburg when the collision occurred.

    The force of the impact sent both cars into a nearby house and left the Saturn barely recognizable beyond a pile of debris.

    “She didn’t have a chance,” said Judy Shew, Coble’s grandmother.

    Coble, 25, was pregnant and had two daughters. Shew is caring for 4-year-old Tabitha and 5-year-old Taylor, who is getting ready to start kindergarten.

    Likewise, Perry, 24, is survived by a daughter who is now 15 months old. His family said Elisa looks at a picture and points to him each night before she goes to bed.

    “He has missed her first birthday, her first words, her first steps,” said Kellie Perry, the victim’s stepmother.

    Machines kept Perry alive for 10 days after the crash. Doctors said he suffered irreparable brain damage.

    Coble and Perry’s family members are unhappy with the sentence. They also expressed frustration that Macias-Marquez was permitted to remain in the country after his arrest in 2011.

    “I don’t understand why he’s still here,” said Lei Lani Vaughn, Perry’s mother.

    Sentencing does not provide any closure, Vaughn said.

    In a letter to the judge, Vaughn questioned who is policing immigration laws in Franklin County.

    “I am one very angry and mad mother who is determined to see justice done for my son and the other victims,” she said in the letter, which was read aloud in the courtroom.

    Through a translator, Macias-Marquez said in court he did not intend to hurt anybody.

    “I am very sorry for what happened,” he said.

    He was sentenced on two counts of homicide by vehicle, one count of aggravated assault by vehicle while driving under the influence, and driving under the influence. He was also ordered to pay restitution exceeding $325,000.
