    Police arrest suspect in rape near San Rafael High School

    SAN RAFAEL, Calif. A suspect in a San Rafael rape case is behind bars after a pedestrian called police to report a man dragging a sobbing 15-year-old girl down the street by her neck.

    A police spokesman says Jorge Alberto Ek-Luna was arrested near San Rafael High School yesterday after allegedly trying to kidnap the girl.

    Before being taken into custody, the 26-year-old Ek-Luna allegedly dragged the teen into bushes near the high school campus and raped her.

    Police are describing Ek-Luna as a recent immigrant from Mexico who was staying in San Rafael.

    He was booked on suspicion of rape, kidnapping and assault with a deadly weapon.

    Principal, students call school safe

    The principal of San Rafael High School said the school is doing everything it can to protect more than 1,000 students who attend classes there.

    Principal Judith Colton fielded inquiries from the media Tuesday, a little more than 24 hours after a 15-year-old San Rafael High freshman was allegedly raped on campus as she arrived late for classes Monday morning.

    Colton said the campus is outfitted with 20 surveillance cameras and has two full-time security supervisors. In addition, the San Rafael Police Department assigns two officers to work with the schools full time, but they travel among all the city's schools, teaching and providing supplemental enforcement.

    Leah Reich, the spokeswoman for the San Rafael City Schools District, said the school's security supervisors were both on campus Monday morning, but they were inside the school monitoring the hallways before class started.

    "(The victim) had barely got on campus that morning," Colton said. "I'm pretty sure this was just a crime of opportunity. This young lady was the victim of a horrendous attack. We're just here to support her and help her get back to her life. We're happy she's OK."

    Students, including senior Hilda Bordas, 17, say they feel safe at the school.

    "This is a safe place to be at. Nobody expected something like that," Bordas said. "It's just one of those things you can't predict."

    The suspect, Jorge Alberto Ek-Luna, 26, of San Rafael, appeared briefly in Marin Superior Court Tuesday with an attorney from the county public defender's office. Formal arraignment was scheduled today before Judge Terrence Boren.

    Ek-Luna is charged with six felony counts, including rape, kidnapping, second-degree robbery, dissuading a witness by force, assault with a deadly weapon, lewd and lascivious acts with a 14- or 15-year old child and two misdemeanors.

    He could face 25 years to life in state prison, according to Linda Witong, deputy district attorney.

    Ek-Luna is being held in Marin County Jail on $750,000 bail. The U.S. Immigration and Naturalization Service has placed a hold on him.

    Ek-Luna also faces misdemeanor charges for a pending driving under the influence case.

    The victim, a freshman from the Canal area, was allegedly raped on campus after walking to school alone Monday morning. The girl told police she remembered passing Ek-Luna at Third and Union streets on the way to school.

    As the girl turned onto campus, the suspect approached her from behind in the parking lot, held a broken bottle to her throat and took away her cell phone. He forced her into nearby bushes and raped her, according to police.

    After the assault, he used the jagged bottle to force the girl off campus, saying he wanted to take her to a motel. A passing motorist, seeing the attacker dragging the girl by the neck on East Francisco Boulevard and Grand Avenue, called 911.

    Police found the pair on East Francisco near Hoag Street.

    San Rafael police spokeswoman Margo Rohrbacher said at least two other witnesses have come forward. One said he was about to call police when he saw squad cars arrive.

    Rohrbacher said the case is unusual in San Rafael because it involves an abduction and assault by a stranger and because the victim was a student on campus.

    "Our thanks go out to the citizens out there who reported it and are alert," Colton said. "Certainly we'll look at the incident. But at this point, I don't know what we could do differently."

    Colton said six counselors were on campus Tuesday. The campus is closed except for lunchtime when students can leave the grounds.

    Colton said police officials were viewing campus videotape Tuesday.

    The school drafted a letter for parents on Monday, notifying them of the incident. Others were notified by e-mail. Then Tuesday, Colton issued a letter to staffers, expressing concern about maintaining the student's anonymity and providing additional details about the incident.

    Students said Tuesday they felt safe on campus and that the incident could have happened anywhere.

    "The biggest thing people need to realize is that this was a random thing and not an issue about security," said sophomore Alex Klein, as he returned from lunch with his girlfriend, Camille Gaito.

    "This could have happened anywhere," said Gaito, 15. "There's no way that we feel threatened. I think most everyone feels safe around here."

    Freshman Melissa Godinez said she and her friends often walk to school, but never alone.

    "This was really shocking," freshman Astrid Carrillo said.

    Witnesses take stand against accused rapist

    Two passers-by who noticed a frightened looking girl being walked by an older man down Francisco Boulevard East testified Monday that they became concerned because the scene did not look right.

    The two men were called as witnesses in a preliminary hearing for Jorge Alberto Ek-Luna, 26, who is accused of raping the 15-year-old girl in February as she was walking to San Rafael High School, where she is a freshman.

    Ek-Luna is charged with six felony counts, including rape, kidnapping, robbery, lewd and lascivious acts with a 14- or 15-year-old child, dissuading a witness by force and assault with a deadly weapon, plus two misdemeanors.

    The victim told police Ek-Luna approached her as she walked to the campus and held a broken bottle to her neck, forced her into some bushes and raped her. He reportedly tried to take her to a motel, dragging her down Francisco Boulevard East.

    Cesar Flores, who was driving in the neighborhood, testified that he was passing by at about 8:40 a.m. on Feb. 13, when he saw a scared looking girl being dragged down the street.

    Flores said he was uncertain about what might be happening but called 911 to make a report. He said the man had his arm around the girl's neck and leaned on her like he might have been drunk.

    Oscar Garcia, who works at a nearby car dealership, said he was taking a test drive and saw that the girl was crying. Garcia said he was acquainted with the victim and saw her walking to school every day.

    Garcia drove toward Third Street on Francisco and turned around to return to the dealership. When he saw the girl he yelled to her from the car window. He felt uneasy about the situation and parked the car to try to call police. Before he got through, he saw a San Rafael police car arrive.

    Ek-Luna is in custody at Marin County Jail on $750,000 bail.

    He has pleaded not guilty.
