Police: Driver In Fatal Crash Is Illegal Immigrant
(CBS4) BOULDER, Colo. Police said a suspect in a deadly accident in Boulder should have never been driving a car since she has been in the country illegally for nearly two decades.
Guadalupe Garcia-Gutierrez, 34, faces charges of careless driving resulting in death, driving without a valid license and driving an uninsured vehicle.
Police said she hit a 28-year-old Boulder man who was on his bike and stopped at a traffic light at Valmont and 29th Street.
The accident happened Monday evening.
Investigators said the cyclist wasn't wearing a helmet and his bike didn't have lights or reflectors.

BOULDER - Police are investigating a fatal accident in which a suspected illegal immigrant crashed her SUV into a bicyclist early Monday evening.
Guadalupe Garcia Gutierrez, 34, the driver of the Nissan Pathfinder, was arrested on charges of careless driving resulting in death, driving a vehicle without a valid driver's license and driving an uninsured vehicle. She was being held Tuesday in the Boulder County Jail on $1,000 bail.
The Boulder County coroner identified the victim as Christopher Woodby, 28, of Boulder.
Witnesses say Woodby, who wasn't wearing a helmet and didn't have a light on his bike, was struck from behind by the Pathfinder.
Boulder investigators say they have probable cause to believe Garcia Gutierrez is in the country illegally. Although she had no credentials on her, police checked her information with the National Crime Information Center database and learned that the U.S. Immigration and Customs Enforcement had issued her a border crossing card, which typically is good for 72 hours, and mandates that the person stay within 25 miles of the border.
However, the database did not disclose when the card was issued, said Julie Brooks, police spokeswoman. The woman has a Boulder address, and police believe she may have been in the United States for at least 16 years, Brooks said.

Driver held in crash that killed bicyclist
BOULDER
A bicyclist died in Boulder on Monday after being hit by a car, police said.
Witnesses told police the bicyclist, Christopher Woodby, 28, of Boulder was stopped in the eastbound left lane on Valmont Road and using his arm to signal a left turn onto northbound 29th Street.
A Nissan Pathfinder traveling the same direction about 7 p.m. struck him from behind, police said.
The driver of the car, Guadalupe Garcia Gutierrez, 34,was arrested on suspicion of careless driving resulting in death, driving a vehicle without a valid driver's license and driving an uninsured motor vehicle, police said in a news release.
The Boulder Police Department said they believe Garcia Gutierrez is an illegal immigrant.

The Boulder Police Department is investigating a fatal accident between a vehicle and a bicycle that occurred at about 7 p.m. on Monday, Oct. 2, at the intersection of 29th Street and Valmont Road.
Witnesses told police that the bicyclist was stopped in the eastbound left traffic lane on Valmont Road using his arm to signal a left turn onto northbound 29th Street when a Nissan Pathfinder traveling the same direction in the same lane struck him from behind. The bicyclist, a 28-year-old Boulder man, suffered severe head injuries and was transported to Boulder Community Hospital where he remained on life support to facilitate organ donation. The bicycle was not equipped with lighting to the front or to the rear of the bicycle. The bicyclist was not wearing a helmet.
The driver of the Nissan, 34-year-old Guadalupe Garcia Gutierrez, was arrested for careless driving resulting in death, driving a vehicle without a valid driver's license and driving an uninsured motor vehicle. Garcia Gutierrez voluntarily submitted to chemical testing, as is routine in accidents involving serious bodily injury or a fatality.
During the investigation, officers developed probable cause to believe Garcia Gutierrez is in the country illegally. Investigators determined that Immigration and Customs Enforcement (ICE) had issued Garcia Gutierrez a border crossing card. It is not clear when it was issued, but there are indications that Garcia Gutierrez has been in the United States for nearly two decades. A border crossing card permits entry into the United States for up to 72 hours at a time and limits travel to within 25 miles of the border unless authorization has been granted to travel further. It is not known at this time if additional authorization had been granted. ICE was notified of the arrest.
