    A nationwide trend among police departments that forbids officers from inquiring about a suspect’s immigration status proved fatal this week when a previously deported man with a lengthy criminal record brutally murdered a veteran Arizona cop.

    The illegal immigrant, Erik Martinez, gunned down a Phoenix police officer, Nick Erfle, after the officer stopped him for jaywalking. With an extensive wrap sheet that dates back to gang violence as a youth and a previous deportation, Martinez shouldn’t have been in the country.

    In fact, he had been deported early last year after a felony conviction and returned to the U.S. to commit yet another crime a few months later in Scottsdale. Had Scottsdale police bothered to do an immigration check on Martinez, they would have learned about his deportation and hopefully contacted federal immigration officials.

    Instead the violent illegal immigrant was allowed to post $300 bail for assaulting his girlfriend when in fact he should have been jailed and charged for returning to the country illegally. A conviction would have got him up to two decades in prison.

    In an effort to minimize the deadly consequence of its don’t-ask-don’t-tell immigration policy, Scottsdale police officials say they have to take race out of the equation when they make an arrest. A Scottsdale Sergeant then asked if Immigration and Customs Enforcement should be called when someone with a French last name is arrested.

    The irony in this horrific case is that the Phoenix Police Department, mourning the loss of one of its finest, is one of those law enforcement agencies that prohibit officers from asking about immigration. The department’s policy has been in place for two decades.

    And the answer to the Scottsdale Sergeant is YES. Probably in this day and age, all arrestees whether they look like they've lived in the US their entire lives or they have a French last name or a Spanish accent should be run through a database upon arrest to determine if the are a legal resident or had been deported 4 times like this scumbag was.

    More and more they deport these scumbags right after they commit a crime without any trial or punishment for sometimes awful crimes. This guy was a sex offender. Since they get off scot free without paying for the initial crime and come back so easily through the porous border, all law enforcement should be checking to see if they at least had the criminal background of being deported let alone any other crimes they had previously been charged with.

    Not trying these people for their initial crimes is a crime itself. I've sighted in the past the people who have set forest fires. When a prosecutor says it is easier and cheaper to not hold for trial and we'll just deport, this sends a clear signal to this criminal and others that there'll be no punishment for the crime.

    Here is a full quote from the whacked Scottsdale Sergeant: "Police have to take race out of the equation when they make an arrest," said Sgt. Mark Clark, spokesman for the Scottsdale Police Department. "Should we call Immigration and Customs Enforcement if we arrest someone with a French last name?"

    Checks of his federal, state and local criminal history revealed no arrest warrants and raised no suspicions that he was in the country illegally.

    "There was nothing else we could have done," Clark said.

    This isn't about race Clark, it is about the criminal history of your newly arrested criminal. I'm not surprised you didn't find anything when you ran one of his alias names. Oh you were just accepting his lie like he was telling you the truth!?!

    Why didn't you check his fingerprints? This probably would have told you who you were dealing with. Isn't fingerprinting an arrestee normal procedure in Scottsdale. A four time deported felon must come up with some fingerprints, because if it doesn't, I guess the system is broken beyond repair.

    This shouldn't be just about police officers being murdered by illegals, it should be about ANYONE who is murdered (or suffers) from the hands of illegals. We need to get really active about this.
