More than once a court had ruled that an employee can not sue for payment for work that was done illegally. This includes unlicensed daycares who are over the limit of children you can watch without a license, work done in growing, harvesting, making or selling a controlled substance. prostitution, ect. These people are simply not entitled to their pay.

On the other hand, if this employer in not required to pay the criminals he knowingly and willingly hired, he is getting a huge financial reward for his crimes. I think he should be fined at least the amount of the payroll he is not meeting with the funds going to pay for the deportation of these criminals.
I suspect the company hesitates to give out checks to "unknown" parties. A company usually has a record of a spouse and will give her / him a paycheck. However, it you're not married and the company doesn't have a record of you, why would they give you a check ?
