    TN: Questions raised about possible undocumented VW construction workers

    Questions were raised Friday that undocumented workers are helping to build Volkswagen's plant expansion in Chattanooga, but the automaker discounted the reports.

    "It's in our contract that all contractors and subs must abide by local, state and federal law," said VW spokesman Scott Wilson. Still, he said, if there's evidence that illegal workers are on the construction job site, the company is "100 percent pursuing it."

    City officials said at a meeting of the Industrial Development Board that they plan to check out the assertions.

    "This is the first I've heard of any issues around the workforce," said City Attorney Wade Hinton. "Perhaps we can look into it and see if there are some issues and challenges and see if there is any validity to the claim and report back to the board."

    Jimmy Rodgers Jr., a board member, said he deals with a lot of people in the local construction industry and "there are a lot of rumblings" about workers who appear to be undocumented.

    "We need local folks to have an opportunity [for jobs] on these projects," he said.

    Rodgers said the issue of possible use of illegal workers is one that affects both union and nonunion contractors.

    "That fair contractor needs a fair chance," he said.

    Sean Kimball, president of the Chattanooga Building and Construction Trades Council, said later he has heard rumors about undocumented employees at the VW building project.
    He said that when the plant was originally constructed that there were undocumented employees on site then.

    "I know before that there were undocumented workers when it was built the first time," Kimball said.

    He said the problem with that is local workers aren't getting jobs and undocumented employees are exploited by contractors.

    But Wilson said that he's "really doubting" that any of the construction workers on site are undocumented. He said the company has put into place procedures to verify worker status.

    The issue came up at the meeting when the city made a request to add $1.65 million to a contract for EMJ Corp. The locally based company handles contract administration and construction management for the city related to incentive grants for VW's $900 million expansion to assemble a new SUV.

    City Engineer Bill Payne told Rodgers that he wanted to get more specifics about possible illegal workers. But, he said, EMJ's role isn't to check documentation.

    "That's something every general contractor has to provide," Payne said.

    James Miller, the board's chairman, asked if contractors need to provide worker documentation to the city.

    "That is a grave concern," he said, adding he'd like to receive back information about the worker issue within a short time period.

    Payne said the city could have a look at the contract of Gray Construction, which is a general contractor for some of the plant work. He said the city is involved in that contract while other work is contracted by VW.
