Being an illegal immigrant "is not a crime" and shouldn't be, Republican presidential contender Rudy Giuliani said yesterday, drawing quick fire from GOP opponent Mitt Romney.

"No, it shouldn't be," Giuliani told talk-show host Glenn Beck when asked if living in the country illegally should be a crime, "because the government wouldn't be able to prosecute it. We couldn't prosecute 12 million people. We have only 2 million people in jail right now."

Aides said later that Giuliani was making a legal point, not a policy statement, on the logistics of arresting so many people.

"My solution," added Giuliani, "is close the border to illegal immigration."

"Mayor Giuliani has the wrong approach on illegal immigration," said Kevin Madden, a spokesman for Romney, the former Massachusetts governor who has attacked Giuliani over immigration for weeks.
