Second man indicted in rollover near Moab

A federal grand jury has indicted a second man in a fatal crash near Moab that killed two Guatemalan woman allegedly being smuggled into the United States.
Noe Luna-Escalona, who was driving at the time of the Oct. 11 rollover, is accused of transportation of illegal aliens resulting in death.
The victims were among 16 undocumented workers in a minivan traveling from Phoenix to Denver, according to investigators.
The maximum penalty for the offense is death. But the federal government has sought the ultimate punishment in a similar case only once - against a truck driver accused of driving a tractor-trailer in which 19 undocumented workers died in Texas.
The driver was convicted, but has been granted a retrial.
In the Utah case, Luna-Escalona originally was believed to be 17 years old and was being held in a juvenile facility. However, prosecutors say he was 18 at the time of the crash and obtained an indictment against him Thursday.
Investigators say Luna-Escalona apparently dozed and drifted off the right side of U.S. 191 about 26 miles southeast of Moab. He then
overcorrected, causing the van to roll several times before coming to a stop. No one was wearing a seat belt.
The man who allegedly was operating the smuggling ring, Ramses Castellano-Lin, was indicted in October on the same charge.
Immigration and Customs Enforcement agents allege that the 25-year-old had picked up 15 passengers in Arizona and made arrangements to transport them to the Midwest and East Coast
