    An organization of Texas sheriffs patrolling the border with Mexico received nearly $5 million from the federal government Thursday, a grant that should keep the group going through at least November 2007.

    The $4.9 million grant represents the first federal commitment to the Texas Border Sheriffs Coalition, said Rick Glancey, its interim executive director. The coalition had previously received about $9 million in state funding for Operation Linebacker, a program designed to catch drug smugglers and other criminals in border counties.

    The additional patrols have markedly decreased crime in 16 border counties, Glancey said.

    "Now who is going to argue with a reduction in crime?" Glancey said.

    Critics, including the American Civil Liberties Union in Texas and state Sen. Juan Hinojosa, D-McAllen, had raised concerns, saying the coalition was overstepping its authority by setting up roadblocks and detaining people who might be illegal immigrants.

    But the coalition has stopped those practices, Hinojosa said. It is focused on targeting crime and supporting the U.S. Border Patrol.

    The legislator said he was pleased that the Department of Justice was supporting the group.

    "Absolutely the money is welcome," Hinojosa said. "A lot of the sheriffs are from counties that are poor and don't have the money or resources to provide the proper equipment. They don't have the firepower to confront some of the drug cartels that use those corridors to smuggle drugs into our country."

    Glancey said he views the money as an extension of the federal government's fight against terrorism.

    "We are concerned about terrorism," he said. "We are concerned because we don't know who they are. We don't want something to happen and to have someone point the finger at Texas and say, 'You didn't know anything about it.'"

    He's right. In this age of the 'blame game' by the media, even though they have NOT given truthful, both sides of the issue coverage, you KNOW that if a terrorist came through Texas, and, God forbid, used a WMD of some kind, Texas would get clobbered by the media.

    Nobody would say...hey, bush, we've been calling for a secure border.....

    Of course the ACLU snakes come slithering in to protect the lawbreakers and this left wing Senator.......he needs to go! If you ask me, the ACLU has overstepped it's authority in every case.

    It is not against the constitution to set up road blocks for illegals. This went to the Supreme Court and was ruled legal.
    In Almeida-Sanchez vs U.S. "A vehicle inside the border and not known to have recently crossed the border may be stopped and and searched only if there is probable cause to believe aliens or smuggled objects are present."
    In roving patrols, a car may be stopped in the interior to question the occupants and probable cause is not required but there must be specific factors which gave rise to suspicion that an immigration violation has occurred as per U.S. vs. Cortez, 449 U.S. 441 (1981). A Mexican appearance of a driver and/or passenger(s) is not by itself sufficient to allow for even a brief stop for questioning as per U.S. vs. Brignoni-Ponce, 422 U.S. 873 (1975) and U.S. vs. Ortiz, 442, U.S. 891 (1975).
    Fixed checkpoints similar to DUI checkpoints are legal and particular motorists can be sent to a secondary inspection area as per U.S. vs. Martinez-Fuerte, 428 U.S. 543 (1976). There are looser conditions than in a roving stop and you can use the Mexican appearance as a basis to pull them over to the secondary checkpoint.
    This is what I learned a year and a half ago and I am unaware of any recent changes. What is frightening is how long this Mexican Invasion has been going on. Those dates from the cases show the problems have never been fully addressed.

    That is disguisting but then I guess the city collects enough property taxes to make up for income lost by the police department!
