SB 160 (CEDILLO) CALIFORNIA DREAM ACT
INSTITUTIONAL STUDENT AID & BOARD OF GOVERNORS FEE WAIVERS

Under current California law, students applying for public colleges and universities who do not possess lawful immigrations status are eligible to receive in-state tuition if they have graduated from a California high school and meet all of the requirements of the California Education Code § 68130.5. However, many of these students who are eligible for instate tuition do not qualify for federal student aid such as Pell Grants or student loans. Even though these students who grown up in our neighborhoods receive instate tuition rates college is still financially unattainable. For many of these students, California is the only home they know so it is imperative that they be part of an educated workforce.

Under existing federal law, a 1982 United States Supreme Court decision ruled that a state may not deny school-age undocumented children the right to public K-12 education. To do so would violate the equal protection clause of the Constitution which applies to any person.

Since we allow these students access to public education throughout their formative years and we encourage them to set educational goals, and to dream of their success, then we should not shatter their hopes by imposing restrictions that bar them from continuing their education at a college or university.

SB 160 THE CALIFORNIA DREAM ACT

This bill would require the Board of Governors for the California Community College, Board of Trustees for the California State University, and strongly recommend to the Board of Regents of the University of California system to allow students who meet the in-state tuition (California Education Code § 68130.5) requirements to compete for the current financial aid available that is administered by the institutions. Students who meet these requirements would also be eligible to apply for and receive a Board of Governor Fee Waiver.
