Report: Suspect in hit-and-run that left Phoenix officer Daryl Raetz dead arrested on drug charge

    Posted: 05/20/2013

While Jesus Cabrera Molina has not yet been charged in the death of Officer Daryl Raetz, he is in custody on separate drug charges, the paperwork shows.
Molina was arrested around 1:15 p.m. Sunday during a traffic stop near Thompson Ranch Road and Grand Avenue in Surprise.
The records show Molina was pulled over by an officer who recognized that the 24-year-old's SUV matched the description of a vehicle involved in the deadly hit-and-run from early Sunday.
According to the court paperwork, Molina's vehicle was found to have significant damage to the center grill and hood, similar to the vehicle seen fleeing the crash that left Raetz dead near 51st Avenue and Cambridge.
Detectives were also able to match a part left at the hit-and-run scene with "the missing areas" on Molina's SUV.
While speaking with and conducting a search of Molina during the stop, a small bag of white powder fell to the ground. The 24-year-old reportedly admitted that the substance was cocaine, and was taken into custody.
Court records show Molina also admitted that he is an undocumented immigrant.
Molina is the registered owner of the vehicle, and his father reportedly told police his son is the only driver. Police are working to confirm who was driving the vehicle at the time of the deadly accident.
Officer Raetz was killed as he wrapped up a DUI traffic stop.
An account has been opened for Officer Raetz's family. The account is at any Midfirst Bank - Hands Across Arizona for the benefit of Daryl Raetz.

On Sunday, police in Phoenix arrested Jesus Cabrera Molina, 24, after he reportedly hit and killed Officer Daryl Raetz while he was conducting a DUI stop.
    ABC 15 reported:
Molina was arrested around 1:15 p.m. Sunday during a traffic stop near Thompson Ranch Road and Grand Avenue in Surprise.
Officer Raetz, 29, had been with the Phoenix Police Department for six years, and was a veteran of the Iraq War. He leaves behind a wife and one child.

Of course, this young man is only the latest Phoenix officer to lose his life because our federal government refuses to secure our border with Mexico...

    -Officer Shane Figueroa
On Oct. 25, 2008, Officer Figueroa was responding to a "shots fired" call when his patrol car was hit by a pick-up truck driven by Mexican national Salvador Vivas-Diaz, who was drunk at the time.
Vivas-Diaz had a history of DUI arrests and had been previously deported.
Officer Figueroa, 25, left behind a wife and a 3-month-old baby.

    -Officer Nick Erfle
On Sept. 18, 2007, Officer Erfle stopped a group of men who were obstructing traffic, one of the men, Mexican national Erik Martinez then shot and killed him.
Martinez had been deported in 2006 for theft charges, but was able to easily re-enter the U.S.
Officer Erfle, 33, left behind a wife and two children.

    -Officer Marc Atkinson
On March 26, 1999, Officer Atkinson, 28, was shot and killed by illegal alien Felipe Petrona-Cabana. Officer Anderson was ambushed by Cabana while on routine patrol.
Cabana was traveling with two other illegal aliens and carrying a pound of cocaine. An armed citizen named Rory Vertigan witnessed the shooting and helped capture the outlaws.
Officer Atkinson served on the Phoenix Police Department for five years. He left behind a wife and an infant son.

Charge filed in Phoenix officer’s death

The arrest of Jesus Cabrera Molina on charges related to the death of a Phoenix police officer might have seemed like a foregone conclusion.

Cabrera Molina, 24, owns the SUV that police believe struck and killed Officer Daryl Raetz near 51st and Cambridge avenues more than two weeks ago, and investigators arrested Cabrera Molina on drug-possession charges less than 12 hours after Raetz was struck.

But it took detectives in Phoenix’s vehicular-crimes unit two weeks to put together enough evidence to conclude Cabrera Molina was driving the SUV when Raetz was hit.

Cabrera Molina, who was formally charged late Monday with manslaughter and leaving the scene of a fatal collision, did not respond to questions as he was rushed past reporters outside Phoenix police headquarters.

Police would offer few details about the evidence that investigators pieced together to put Cabrera Molina behind the wheel at the time of the wreck, other than to say the investigation was thorough and remains active.

“This is still very much an ongoing investigation as our detectives continue to put things together,” said Sgt. Tommy Thompson, a Phoenix Police Department spokesman. “Through the evidence, through interviews with witnesses as well as interviews with leads, we developed that probable cause to charge Jesus Cabrera Molina with those crimes.

“We believe he was the individual who was driving the 2000 Expedition that struck Officer Raetz and that he was the driver that fled the scene.”

Investigators also believe Cabrera Molina was impaired when his car struck Raetz, Thompson said, though Thompson could not provide any details about the substance police believe was influencing Cabrera Molina.

Police said Cabrera Molina had a passenger in the SUV when Raetz was struck, but Thompson said that person likely will not face criminal charges.

Raetz, 29, was investigating an incident of suspected drunken driving shortly after 3:30 a.m. on May 19 near 51st and Cambridge avenues when he was struck by a green Ford Expedition, which then fled the scene.

Cabrera Molina was arrested at about 1:30 p.m. on May 19 in El Mirage after a Surprise police officer stopped an SUV that matched the description of the vehicle that struck Raetz.

Police said Cabrera Molina had a small bag of cocaine in his pocket when he was stopped. He was booked into jail on suspicion of drug possession.

Federal immigration officials also issued a detainer to take custody of Cabrera Molina because they said he is in the country illegally and skipped a court date after posting a $5,000 bond in 2012.

With Cabrera Molina in custody on suspicion of drug and immigration violations, Phoenix investigators had time to work through the information that witnesses provided and other evidence left behind to conclude he was the one driving.

Police released a photo of the SUV within hours of Raetz being struck but would not release information about Cabrera Molina, even after Surprise police arrested him on the drug charges. Instead, police repeatedly stressed that they had not identified who was driving the SUV and continued to ask for the public’s help. “We wanted to make sure early on that we didn’t close the net, so to speak, prematurely,” Thompson said.

Phoenix Police Chief Daniel V. Garcia said Cabrera Molina’s arrest could bring some peace to Raetz’s family and his friends at the Police Department.

“We still have a very long journey ahead of us as we move forward on the death of Officer Daryl Raetz,” Garcia said. “But in relation to bringing justice to this issue and justice to his family and the Phoenix Police Department, we believe very strongly that we’re headed in the right direction.”
