    Arizona lawmaker moves to ban illegal immigrants from schools

    The Arizona lawmaker behind the state's controversial crack down on illegal immigration introduced new legislation this week that would turn public school administrators into de facto immigration enforcement agents.

    Russell Pearce, Arizona state senate president, proposed a bill Monday that would deny the children of undocumented immigrants the right to attend public elementary, middle and high school, Arizona's East Valley Tribune reported. The bill also prohibits illegal immigrants from attending college and makes it illegal for undocumented immigrants to drive. Driving without proof of legal residence will land drivers in jail for 30 days. If caught by police, the state may impound and sell illegal immigrant's cars.

    Pearce called the legislation "clean up."

    "All it does is do what the voters have passed in terms of no taxpayer dollars for illegals," Pearce said. "It just ties it up."

    Like its' predecessor SB1070, which requires local police to enforce federal immigration laws, SB1611 will likely wind up in the Supreme Court. Case law prohibits states from discriminating against students for their immigration status.

    "They're trying to create tests. This is all aiming for Supreme Court test cases by doing something that is over the constitutional line," Gabriel Chin, a professor at the University of Arizona School of Law, told the Huffington Post. "The problem is that all of these people have taken an oath to support the constitutions of the United States and Arizona. It's really alarming and astonishing that they would deliberately violate the Constitution in this way."

    Pearce, who authored SB1070, is also pushing a bill that would deny citizenship to the U.S.-born children of undocumented immigrants.

    "If we're going to stop this invasion — and it is an invasion — you're going to have to stop rewarding people for breaking those laws," Pearce told the East Valley Tribune after the Senate Appropriations Committee approved the bill Tuesday. "I make no apology for demanding the taxpayers be protected."

    According to Tucson Citizen, Pearce is planning to run for U.S. Congress in 2012. In the meantime, the group Arizonans for Better Government has filed paperwork to recall Russell Pearce from his position as a state senator. So far, more than 1,500 people have signed the petition. To force a recall election, the group needs to collect 7,700 signatures by the end of May.

    I do not mind the immigration situation (actually invasion) going to the Supreme Court except Obama has placed two of his agents into that position and they both talk like the Constitution no longer serves our purpose today

    It's really about time that someone in a position of authority started publically calling this invasion what is it...an INVASION! Kudos to Pearce, as I believe Arizona is paving the way and providing the necessary courage which will inspire the rest of this country to stand up and fight this illegal invasion.

    They both talk like that because that's exactly what they both believe, along with obama. The Constitution was written by a "bunch of White guys" which serves no purpose for obama and his ilk. IMHO, they hate our Constituion and everything it stands for and are doing their best to dismantle the principles for which that document stands. Especially since there were no "wise latinas" around at the time to add their input!

    Obama was looking to appoint two of the most left-wing radicals to the Supreme Court he could find. If Paul Krugman had a law degree he would have been a shoe in!

    If and when this case ever makes it to the Supreme Court, I would fully expect Sotomayor to recuse herself from this case because of her close ties with la raza, (as well as public comments she had made) for over 20 years. The perception is she cannot reach a fair and unbiased decision in such a case because of her personal feelings to the issue at hand.

    Hooray for Russell Pearce. If only this would happen in Texas. Doubt that it would though since most of Texas is ruled by "The Race".

    Pearce is my new hero. I like the logic, it makes perfect sense. If one is illegal, then they shouldn't have the right to anything, except deportation and a fine

    This is the bill we have been waiting for. It has a few more hoops to get through and a signature from the governor. You guys in AZ, what will she do? Would she sign it?

    In 1982 Plyer v Doe the Supreme Court ruled that 62 million a year did not constitute an interest for TX. They are now spending 9 billion dollars a year on illegal immigrants. What the Supreme Court did was make a ruling with no boundaries. If it takes every penny that a taxpayer makes to educate alien children then that's what the ruling would require.

    The Supreme Court ruled that it was not a widespread problem and that people weren't coming here for an education. But 25 years later the father of the little Does, said I just wanted my children to get an education.
    The poor Mexicans could not pay the tuition asked for but they some how were able to get lawyers.

    This has got to be the only immigrant group that has forced themselves upon us and makes us pay for them. TX will be majority Hispanic in nine years. Can we trust TX to protect our borders in the future?

    Every County in the country needs to pass this ordinance. Then you will see the fur fly.

    welcome jd421.

    As for this law..Yes it will go to the courts for sure and every crackpot latino activist will be stomping their sandles on the courthouse steps. What it going to boil down to is the satates are going to tell the WH and th courts that if they are not going to act int he best interest of those in the state then that state is going to take matters into their own hands.
