CA-Day Laborers sue Calif. city over ban on seeking work

Day Laborers sue Calif. city over ban on seeking work

    The Associated Press
    Tuesday, Feb. 2, 2010

SANTA ANA, Calif. -- Day laborers say they have sued the city of Costa Mesa over a ban on seeking work on the street.

The workers' lawyers told reporters they filed the lawsuit Tuesday in federal court in Santa Ana, alleging the ban violates their clients' civil rights.

It is the latest in a series of lawsuits filed by day labor advocates against cities that limit workers' right to solicit employment on street corners.

The lawsuit comes after Costa Mesa police posed as employers last year and arrested a dozen laborers. It also comes as day labor advocates say they have seen more American citizens lining up at labor centers around the country because of the recession.

A voicemail message was left for Costa Mesa's city attorney.

No one has the "right" to loiter in the street, even if it is to get work. You have to have a permit to do business in public. If you want to open a lemonade stand you need a permit. If you want to make jewelry and set up a table to sell it, you need a permit. THAT IS HOW WE DO IT IN USA. Why does everyone need a permit except when it comes to illegal aliens? Never mind dont answer that it was a stupid question.

Article 33 of the Mexican Constitution says, "...the Federal Executive shall have the exclusive power to compel any foreigner whose remaining he may deem inexpedient to abandon the national territory immediately and without the necessity of previous legal action.

Since it's a violation of federal law for illegal aliens to work in the US, isn't this lawsuit a nuisance suit? There are also laws against loitering and soliciting, why do these people they have special rights that no one else has? Why aren't these advocates fined for cluttering the courts with nuisance lawsuits?

What is scary is what I saw when I went to the Home Depot in Hollywood Florida this morning. The day laborers were split up in 2 groups one had 2 men which were illegals and another of 6 men who were Americans seeking work. Before it was only illegals. The American consist of both white and black men and they were talking to each other while trying to get work. They weren't too bad as they weren't harassing people as much as the illegals do.

What kind of attorneys take these cases? Always trying to bend the rules.

Illegal aliens by federal law can not work in the US.

LOL! That was my first thought also. Something about the words "solicit" and "street corners" in the same sentence conjures up a sordid image.

The kind that work for the ACLU, as I believe they are suing the city on behalf of the illegal invaders.
