Law enforcement agencies say they followed policies and proceedures, but an illegal alien, accused of sexually assaulting a nine year-old Denver girl, was still able to post a bond and flee the country.
The man, who called himself Manuel Flores, was arrested February 15 and accused of raping and sodomizing his girlfriend's daughter. According to police documents, he was not able to provide a Social Security number or driver's license. When he was booked into the Denver Jail, he told Officers he was born in Moralos, Mexico.
A Sheriff's Department spokesman says they alerted federal immigration officials that Flores might be an illegal alien, but ICE apparently did not put an immigration hold on him. Judge Andrew Armatas set as $35,000 bond, which legal observers say is low for someone suspected of seuxally assaulting a child. But before prosecutors had a chance to argue for a higher bond, Flores put up the $3500 dollars necessary to bond out, and fled to Mexico.
Bounty hunter James Ness discovered Flores real name and tracked him to his hometown in Mexico. Ness says he provided the information to prosecutors, but there is no move to bring the suspect back to the United States. Ness says he thinks this case fell through the cracks, but he adds, "But the crack is huge. A lot of people fall into that crack."
ICE and the Judge did not respond to Fox31 calls. The Denver Sheriff's Department says they report roughly 20 suspected illegal aliens under arrest to ICE each day. But the federal agency typically puts holds on only two or three.

Feds Let Illegal Immigrant Child Rapist Get Away
Highlighting the U.S. government’s ongoing failure to protect Americans from violent illegal immigrants is the case of a Mexican man who sexually assaulted a Colorado girl yet posted bail and fled south of the border because immigration officials failed to act.
The horrific crime and subsequent negligence by authorities took place in Denver. The illegal alien, who said his name is Manuel Flores, raped and sodomized his girlfriend’s 9-year-old daughter and was arrested by local police.
Because the man could not provide a Social Security number or driver’s license when he was booked at the Denver jail, the sheriff’s department alerted federal immigration officials that he might be in the country illegally.
But the Homeland Security agency in charge of detaining such offenders, Immigration and Customs Enforcement (ICE), failed to issue a crucial immigration hold that would permit long term incarceration and subsequent deportation. So the man posted the $3,500 for his $35,000 bond and fled to his native Mexico.
Legally, there was nothing more for local authorities to do once the judge set bail. A bounty hunter tracked the man in his Mexican hometown and, although the information was given to prosecutors, there has been no effort to bring him back to the U.S. so that justice can be served.
Under a 2005 agreement with ICE, the Denver Sheriff’s Department regularly reports suspected illegal aliens that have been arrested. Of the roughly 20 suspected illegal immigrants the sheriff reports daily, ICE puts holds on only two or three. The agency clearly missed the boat in this case.

Why was he allowed bail? unbelieveable, I'm sorry but they should not even have set bail for scum like this!

A nine-year-old Denver girl and her family are waiting for justice in the case of an illegal alien accused of sexually assaulting her. And a local Bounty Hunter says Denver Police are turning down federal offers to help.
The man who called himself Manuel Flores was arrested in February for investigation of sexual assault on a child by a person in a position of trust. Although the Denver Sheriff's Department notified federal immigration authorities that Flores was a suspected illegal alien, ICE did not place a hold on Flores.
Denver Pretrial Services recommended a lower than usual bond, and a few days after his arrest, Flores posted bond and fled. Bounty Hunter James Ness tracked Flores to his hometown in Mexico. Ness tells Fox31 he alerted the U.S. Marshals Office in Denver and agents there were ready and willing to help apprehend the fugitive.
However, Ness tells Fox31 the Marshals Office says when they contacted the Denver Police Department, police told him they were not interested in any help.
Ness says, "Nobody's taking this personal except for this little girl and she's sitting home on her couch and she's scared to death that this guy's going to come back." A spokesman for the Denver Police Department says he was unable to contact the detective on the case so he could not comment specifically. But he says he thinks the Police would be willing to take any help they could get on a case like this.
