Man admits rape of 9-year-old

A Brookings area man has admitted raping a then 9-year-old girl three years ago.

Miguel A. Alva Gonzalez, 30, also known as Alejandro A. Gonzalez, was initially facing a two-count indictment for first-degree rape. He pleaded guilty to one in Brookings County Circuit Court on Tuesday.

Gonzalez was accused of raping the girl in Brookings County on at least two separate occasions between Oct. 1, 2006, and Jan. 31, 2007.

State's Attorney Clyde Calhoon said the victim was staying overnight at a rural Brookings County farmhouse , where Gonzalez and his girlfriend lived, when he sexually assaulted the child.

In exchange for Gonzalez's guilty plea this week, Calhoon agreed to dismiss the second rape count.

The prosecutor said Gonzalez could have been facing other similar charges in Brookings or Kingsbury counties, but no others will be brought against him.

Calhoon is also recommending the minimum mandatory prison time for Gonzalez 15 years in prison. First-degree rape is a Class C felony punishable by up to life in prison and a $50,000 fine.

After accepting the defendant's guilty plea, Circuit Judge Tim Tucker ordered a pre-sentence investigation, including a psychosexual evaluation.

Sentencing has been scheduled for Jan. 11, and Gonzalez is being held without bond until then. Officials are also detaining him on an immigration hold.

Court documents list both Toronto and Arlington addresses for Gonzalez.
