Tucson jury in Border Patrol agent’s slaying trial in recess

Jurors have adjourned for the day after another four hours’ deliberations Monday in the retrial of a U.S. Border Patrol agent charged in the death of an illegal immigrant.
Jurors now have deliberated about 13 hours over whether to acquit or convict Agent Nicholas Corbett on second-degree murder, manslaughter or negligent homicide in the January 2007 death of Francisco Javier Dominguez Rivera of Puebla, Mexico.
Three witnesses, including Dominguez’s two brothers, testified during the U.S. District Court trial that Dominguez was kneeling to surrender when Corbett shot without provocation.
Corbett’s attorneys said he shot in self-defense as Dominguez tried to smash his head with a rock.
Corbett’s first trial ended in March with a deadlocked jury.
