A twice-deported man who was shot by police as he robbed an Owasso convenience store last year pleaded guilty Friday to the heist as well as to a related firearm charge.

Jose Luis Moreno, 24, admitted in federal court in Tulsa that he robbed the Kum & Go store at 10603 E. 86th St. North while brandishing a .22-caliber rifle on July 21.

He was shot by Owasso Police Detective Jason Woodruff, who was refueling his car at the store when another customer told him that an armed robber was inside.

U.S. District Judge Gregory Frizzell is set to sentence Moreno on May 11. Moreno's lawyer, Beverly Atteberry, estimated that he faces about 15 years in prison.

Atteberry told the court that Moreno is not a U.S. citizen and has been deported twice to his native Mexico.

Federal court records show that in June 2005 Moreno was sentenced to 10 months in prison for possession of a firearm by an illegal alien and then received nine months in prison in March 2008 when his supervised release was revoked.

Also, Moreno pleaded guilty to resisting an officer in 2009 and to burglary of an automobile in 2004, Tulsa County District Court records show.

The robbery case is being prosecuted in federal court under the Hobbs Act, which allows federal jurisdiction when businesses that engage in interstate commerce are robbed.
