    A U.S. district federal judge ruled Wednesday that the Irving school district's at-large trustee elections system does not violate the Voting Rights Act. Plaintiff Manuel Benavidez, who twice ran unsuccessfully for the board, had argued that the voting system denied representation to Hispanic voters. He requested the creation a single-member district elections system. Judge Sidney Fitzwater's ruling Tuesday was notable because Benavidez won a voting rights lawsuit against the City of Irving, that time decided by Judge Jorge Solis.

    In his ruling, Fitzwater noted that the 2000 Census showed that roughly 60 percent of Latino adults living within the school district that year were not citizens, and therefore made up only about 17% of eligible voters.School district attorneys had argued that there were not enough U.S. citizen adult Hispanics able to vote and therefore a district with a majority of those voters could not be drawn. Their argument focused on the high population of immigrants residing in the district. Attorneys for Benavidez had argued that according to the Census' 2007 American Community Survey updates three districts with a majority Latino voting-age population could be drawn. They pointed out that cities use the data for planning purposes. However, Fitzwater said the 2007 data was not accurate enough to rely upon because of its margin of error.

    There are currently no Hispanic trustees on the Irving school board, and about 69% of students are Latino. The judge did note that if the 2010 Census shows that there are enough eligible Hispanic voters that "Benavidez may be able to obtain the relief he seeks--trustees elected from single member districts--without the need for another lawsuit."

    But the 2010 census will be contaminated with ILLEGAL ALIENs on it and not claasified as such which could generate more representives for those districts falsely

    Exactly! It's gerrymandering and the only way Manuel Benavidez would ever get elected. Using illegal aliens.
