They have protections as people. They do not have protections as citizens, because they aren't citizens. They do not have protections as immigrants because they aren't immigrants. They do not have nonimmigrant protections such as visa holders, because they are not visa holders who agree to forfeit their right to firearms among other things in exchange for access to work in our country. Do they have rights as people in the United States? Certainly, why wouldn't they? According to federal law, being in the country illegally is a misdemeanor. According to federal law and courts, they can't be detained after so many days without a bond. According to federal law and courts, they can't be deported without a judicial hearing. According to federal policy, their children born here are US citizens. According to the US Supreme Court, they are entitled to public education. According to the federal government, they have the right to protest in our streets, public buildings, and other public areas. According to the federal law, illegal aliens are required to register with Selective Service for military conscription which generally involves bearing a firearm. According to federal government policy, illegal aliens are serving in the US military and usually bearing a firearm.

How can you make the children of illegal aliens born in the US without the right to keep and bear a firearm to protect them or yourself?

How can you make illegal aliens register for a potential draft or allow them to join the US military without the right to bear a firearm to fight a war?

What the federal government has done all these years is violate the US Constitution. It picks and chooses what rights it wants to hand out to whom, and that is wrong, that is unconstitutional.

What too many Americans have found acceptable is creating a second class group of persons living and operating in the country illegally with the rights you don't mind them having versus the ones you do. Well, as long as you allow them to be here, they have all the Constitutional protections of any person in the United States. If you don't want that, you better get on board with mass deportations and the toughest border security this world has ever seen. Otherwise, you're doomed.

Correct! They legally have very few rights. And because they have not submitted to the contract with America, by legally obtaining a Visa, they are afforded none of the rights legal visitors and citizens enjoy.

So Judy subscribes to the idea that bad behavior justifies more bad behavior. And I love the stretch that "military conscription which generally involves bearing a firearm" justifies their use and possession of a firearm at all times! NO! That only authorizes them while on duty!

Javier Perez, a 28-year-old illegal alien from Mexico, is claiming that he has Second Amendment rights under the U.S. Constitution and therefore is being unfairly charged with possession of a gun.


In July 2016, Perez allegedly fired a .380-caliber semiautomatic pistol on a public sidewalk in Brooklyn, New York to fight off a rival street gang, according to the New York Daily News.


If the illegal alien gang member is convicted of firing the pistol, he would receive a maximum sentence of ten years and would likely be deported from the U.S., as the Immigration and Customs Enforcement (ICE) officials say they will take Perez into custody should he be released.


Perez and his attorney said he has a Second Amendment right to carry a gun even though he is in the U.S. illegally, telling the New York Daily News:

IMO, it's you that seems to have difficulty distinguishing the difference between the constitutional rights of an illegal alien and a United States citizen.

Not every person that gets their foot in country is entitled to the same rights as legal citizens and this seems to be the logic of the open borders crowd to justify the flooding of the country with foreign nationals.

There is an abundance of reasons to restrict foreign nationals to bear arms in the country as it stands currently, it is against Federal law. Illegals plug up the court system with their billionaire backed lawyers chinking away at existing law to get far more than they are entitled to. Let him do his 10 years and send him back where he came from.

Illegal aliens aren't entitled to anything in our country, that's why they should be deported immediately, within 48 hours of an arrest, along with every illegal alien member including minor children even those born in the USA in their household, family, residence, work place, gang, church, school, business, neighborhood, along with every illegal alien those people are associated with in any way, shape or form in their city, county and state, until one day we wake up and ask "where are all the illegal aliens?", because there will no longer be any illegal aliens in the United States, because they were all rapidly arrested and deported, quickly and quietly.

We have to GO NUCLEAR, with a RAPID CHAIN REACTION DEPORTATION PLAN.

Wasting years on prosecuting an illegal alien over a gun possession charge only to cost taxpayers millions of dollars in the process makes absolutely no sense to me at all, and worse, this illegal alien is empowered due only to the fact that he hasn't already been deported to place himself in the center of the stage to debate and defend the 2nd Amendment to the US Constitution. How truly pathetic is that?!
