A federal prosecutor said Thursday that authorities likely will not seek the death penalty for the driver of a pickup that rolled last week and killed two occupants.
Authorities believe Eswin Enrique Aquino-Lopez was the driver of a Ford F-150 carrying seven undocumented immigrants from Mexico and Guatemala on June 7. The truck overturned about 20 miles east of Hurricane on State Road 59, probably due to driver fatigue, according to the Utah Highway Patrol.
A 27-year-old man and a 31-year-old woman were ejected from the truck and died. Aquino-Lopez, 23, and two others were wearing seat belts, investigators said.
Aquino, a Guatemalan who allegedly entered the United States illegally, has been charged with transporting illegal aliens resulting in death. The charge carries a maximum punishment of death.
The six survivors in the rollover, ages 20 to 35, were treated at a St. George hospital for minor to moderate injuries. They were then taken into custody by U.S. Immigration and Customs Enforcement (ICE). Officials have not disclosed their names or the identities of the dead victims.
