Two Venezuelan men, who were illegally in the U.S., were arrested after they kicked a Border Patrol agent in the chest and punched him in the face, court records state.

Luiscar Godoy-Hernandez, 20, and Gregory Morillo-Quinto, 26, were arrested Monday after they allegedly assaulted a Border Patrol agent who was investigating a report of a group of migrants in West El Paso, FBI El Paso officials said.

The agent, who was in a marked Border Patrol vehicle, heard a call on his radio about 6:50 a.m. Monday regarding four people believed to be illegally in the U.S. near Doniphan and Sunland Park drives, according to a federal complaint affidavit.
He went to investigate the report when he saw the group near the El Paso Lumber & Plywood Inc. warehouse located at 3880 Doniphan Drive.

The agent then got out of his vehicle and questioned the group in Spanish. The group told the agent they were from Venezuela and did not have any proof of residency nor any documentation allowing them to live in the U.S., the affidavit states.

The four people were then detained and placed in the back of the agent's vehicle.

The agent then saw Godoy-Hernandez and another man in the area, the affidavit states. The agent approached the men and questioned them in Spanish. Both said they were from Venezuela and were not legally allowed to live in the U.S.

The agent then detained the men and placed them in his vehicle.

As he was placing Godoy-Hernandez in the vehicle, the other migrants in the vehicle began "swaying back and forth as if they were attempting to escape from the vehicle," the affidavit alleges.

The agent, who believed the people in the vehicle were escaping, pulled out his pepper spray canister, the affidavit states.

Godoy-Hernandez then allegedly used both his feet to kick the agent in the chest.

The kick caused the agent to drop the pepper spray and provided enough space for the people in the vehicle to escape.

As the agent "regained composure," he grabbed Godoy-Hernandez by his jacket resulting in the two men pulling on one another, the affidavit states.

Godoy-Hernandez allegedly punched the agent on the right side of his face. He then was able to break free from the agent's grasp and began running away.

The agent returned to his vehicle and began pursuing the migrants on Doniphan Drive. The agent caught up to Godoy-Hernandez and detained him without further incident, the affidavit states.

Godoy-Hernandez was placed in the back of the vehicle and the agent began looking for the people who fled. The agent then found a group of three people standing at the corner of Sunland Park and Doniphan drives.

He believed the group was part of the migrants he detained earlier, the affidavit states. He activated his overhead patrol lights and attempted to detain the group. Morillo-Quinto was part of this group.

The group then fled from the agent.

The agent chased Morrillo-Quinto toward a levee where he was able to grab Morrillo-Quinto by the shirt, the affidavit states.

Morrillo-Quinto then allegedly grabbed the agent by his collar and swung at the agent with his fist. He struck the agent on his ear, the affidavit states.

A good Samaritan and an El Paso County constable in the area witnessed the altercation and ran toward the agent. They then assisted the agent in detaining Morrillo-Quinto without further incident, the affidavit states.

Morrillo-Quinto later allegedly admitted to hitting the agent. He told investigators he fled from the agent because he was "afraid of getting arrested," the affidavit states.

“I condemn this violent behavior as such actions pose a risk to our border security mission and most importantly to the agents of the El Paso Sector, who are fully committed to their duties of safeguarding our nation’s borders,” U.S. Border Patrol El Paso Sector Acting Chief Patrol Agent Peter Jaquez said in a statement. “We will not tolerate these violent assaults on our agents and will continue to seek criminal prosecution against such aggressors.”

FBI El Paso agents arrested Morillo-Quinto and Godoy-Hernandez on suspicion of assaulting on a federal officer, officials said.

“Our partners at USBP put their lives at risk each and every day while protecting our nation’s borders,” FBI El Paso Special Agent in Charge Jeffrey R. Downey said in a statement. “We are grateful this USBP Agent didn’t sustain serious injuries and was able to go home to his/her family today. Assaults on Border Patrol agents or any other federal agents/officers or task force officers will not be tolerated and will be addressed swiftly by our office so they can continue to carry out their sworn duty to protect our communities.”

The men were booked Monday into the El Paso County Jail without bond, jail records show.

A detention hearing for both men is scheduled for Wednesday at the Albert Armendariz Sr. Federal Courthouse in Downtown El Paso.

Every damn one of these mongrels need to be deported! We are not safe in our own country. Hand those UACs over to their Embassy to send back, they will grown up to hate us.

They attack law enforcement and they will attack us and our children.
