Waukesha sexual assault suspect is an illegal immigrant

Waukesha - A man charged with attacking two women and raping one of them in Frame Park in separate attacks last month is an illegal immigrant who is believed to have been deported from the country in the past, Waukesha County District Attorney Paul Bucher said Wednesday.

U.S. Immigration and Customs Enforcement officials have been notified about the arrest of the suspect, Fernando Juarez Decion, and have placed a detain order on him to bar his release from custody if he is able to post the $150,000 bail that has been set in his case, Bucher said.

Bucher said he notified federal immigration officials about Juarez Decion this week after learning that he was an illegal immigrant who apparently returned to the United States after being deported sometime in the past.

Last month, Bucher, who is running for state attorney general and has made a campaign issue of illegal immigrants in the criminal justice system, contacted immigration authorities about another Waukesha crime suspect, Nicolas T. Arias.

In that case, Arias, 25, agreed to waive deportation proceedings and was returned to Mexico in lieu of being prosecuted for six criminal counts accusing him of using his cellular telephone to take photographs under women's dresses and skirts in Waukesha County. Bucher agreed to waive Arias' prosecution on the charges to speed his deportation, but his office intends to have the case reinstated if Arias returns to the U.S., something Arias' attorney does not foresee.

Decion, 30, was charged June 28 with three felonies of second-degree sexual assault by use of force, robbery with use of force and substantial battery for an attack on a woman he met three days earlier at Fiesta Waukesha in Frame Park, a criminal complaint says.

He was also charged with misdemeanor battery in an attack June 15 on a woman on the west side of the Fox River just across from the park, according to a complaint.

Juarez Decion was released on a signature bond on June 20 following his arrest on suspicion of the first attack

Juarez Decion is known by at least 12 aliases and has no permanent address, according to court records. He is scheduled to appear in court next on Friday.

He was being held Wednesday in the Waukesha County Jail.

This is now becoming an almost daily occurrence so the first pargraph should be made boilerplate and the appropriate names of the perps and the location added.

And Bush still wants these "good-hearted" folks here and encourages us to be "compassionate."

WAUKESHA - A man severely beat and raped one woman in Frame Park and battered another despite having been in the metropolitan area for only a few weeks, court records allege.
Fernando Juarez-Decion, 30, was ordered held on $150,000 cash bail Wednesday after he was charged with one count each of battery, second-degree sexual assault, robbery and substantial battery. If convicted, he faces more than 55 years in prison.

According to a criminal complaint, a 26-year-old woman reported to police June 15 that she was walking along the shores of the Fox River when she heard someone behind her, and a man wrapped his arms around her, forced her to the ground and punched her in the face. The woman was able to get away, but police allegedly found Juarez-Decion nearby.

Waukesha - A man who police said may have been living in Frame Park the last couple of weeks was charged Wednesday with the rape and battery of one woman and the battery of another woman for incidents authorities say occurred in and near the park.

Fernando Juarez Decion, 30, was charged with three felonies of second-degree sexual assault by use of force, robbery with use of force and substantial battery for an attack on a woman he met Sunday at Fiesta Waukesha in Frame Park, a criminal complaint says.

He was also charged with misdemeanor battery in an attack June 15 on a woman on the west side of the Fox River just across from the park, according to a complaint.

Juarez Decion was released on a signature bond on June 20 following his arrest on suspicion of the first attack. He was in the Waukesha County Jail on Wednesday in lieu of $150,000 bail, and is scheduled to be back in Waukesha County Circuit Court today.

Juarez Decion is known by at least 12 aliases and has no permanent address, according to court records.

According to the criminal complaint:

A 49-year-old woman was with friends at Fiesta Waukesha on Sunday. While she danced in the main tent, a man she did not know kept asking her to dance with him. She refused repeatedly, but at one point did join him for a dance.

The man, who was later identified as Juarez Decion, followed her afterward even after she told him not to, the complaint says.

When they reached the floral gardens, the woman told police, the man pulled her into the bushes and, using profane language, demanded that she have sexual intercourse with him, the complaint says. She refused, and he punched her in the head and neck, then squeezed her neck, and she temporarily lost consciousness, according to the complaint.

When she regained consciousness, he threatened to kill her and repeatedly sexually assaulted her, according to the complaint, which says he also ripped a gold necklace with a cross from her neck and stole her cell phone.

The woman ran to a Fiesta Waukesha worker, who called police at 11:43 p.m. When police arrived, the woman was disheveled, upset and covered in mud. She had swelling on her head and neck and had difficulty speaking because her mouth was swelling. She was taken to Waukesha Memorial Hospital for treatment.

Juarez Decion was arrested later that night in the park. He had the woman's cell phone and told police she had asked him to hold it for her and that the sexual intercourse was consensual, the complaint says.

In the June 15 incident, a woman, 26, was walking on the west side of Frame Park near the bathrooms about 9 p.m. when a man grabbed her from behind and forced her to the ground, according to the complaint.

The man, who was later identified as Juarez Decion, punched her in the face, knocking off her glasses, and she screamed when he continued to punch her, the complaint says. He tried to drag her into the trees, but she freed herself and ran for help, finding two people who called the police, according to the complaint.

WAUKESHA - A transient man who allegedly beat and raped a woman in Frame Park and battered another should submit to HIV testing, state attorneys requested Friday in a hearing in Waukesha County Circuit Court.

Fernando Juarez-Decion, 30, will appear in court at 10 a.m. Friday, where his attorneys said they will defend against the possible HIV test. A preliminary hearing and bail hearing also are scheduled for that court date.

Illegal immigrant pleads guilty to 2 attacks

Waukesha - A man who attended a festival here pleaded guilty Thursday to two criminal counts stemming from attacks on two women, one of whom was raped, in the Frame Park area earlier this summer.

Fernando Juarez Decion, 30, pleaded guilty to one count of battery and one count of second-degree sexual assault.

The sexual assault charge was filed against Decion for an attack on a woman he met June 25 at Fiesta Waukesha in Frame Park, a criminal complaint says. The misdemeanor battery charge concerns an attack June 15 on a woman on the west side of the Fox River just across from the park, according to a complaint.

Juarez Decion, an illegal immigrant, is known by at least 12 aliases and has no permanent address, according to court records. He is being held in the Waukesha County Jail pending sentencing Nov. 30 by Circuit Judge J. Mac Davis when he faces prison terms totaling more than 40 years.
