CHARLOTTE, N.C. (WBTV) - Two men suspected of killing a man outside an east Charlotte complex over the weekend are in the country illegally, WBTV has learned.

Police arrested Yaair Uresti, 20, and Cruz De Espana, 19, last year in Mecklenburg County on unrelated charges. Both were identified as illegal immigrants under the Federal 287-G program.

Yet they still got out on bond, free to commit more crimes.

Sheriff Chip Bailey says its frustrating problem they see again and again.

"Something needs to be fixed," he said. "We all know that. It needs to be fixed in Washington. It can't be fixed locally."

Bailey says one federal standard made impossible for them to keep these two men off the street: their age.

Even though both Uresti --an admitted MS 13 gang member-- and De Espana were jailed for lesser charges they were allowed to make bail.

"The key was the age," Sheriff Bailey points out. "Under the ICE standards if you're under 19 they consider you a juvenile or minor. It doesn't matter if the parent or the guardian is in the country legally or illegally. It's just if you're here with them, you, ah, can be released to their custody."

As frustrating as this age loophole is, Bailey insist the 287-G program works.

"It's identifying these people," he said. "It's telling us who they are. If they've had prior contact and any problems in the past then found out through that database."

The sheriff also told WBTV they have identified almost 14,000 illegal immigrants and have deported nearly 9,000 those since the program started in 2005.

We have to shut down ICE. ICE is demonstrating over and over that they're a bunch of idiots with rules that are getting Americans killed, time and time again. Who in the hell gave ICE authority to force the release of 2 illegal aliens to the custody of their illegal parents??!!

No more money to ICE. No more authority to ICE. States, you have to take responsibility for enforcing US immigration law. YOU have to grow both a spine and a pair and enforce our laws to protect our citizens.

If ICE won't take them and deport them, then state and local police will have to do that as well.

Sorry to be so critical, but I consider that a pretty discouraging statistic. Less than 5% of the illegals living in or traveling through Charlotte over the past 5 years were "identified", and only about 2/3 of those ended up deported. Of that meager amount at least half returned without consequence.

No offense to the Sheriff or his predecessor, but 287g is only skimming the surface and is little more than fluff for the Feds. Hate to say it, but I'm beginning to think nothing is better than something.

When will America wake up and realize their country is being stolen from them without ever firing a single shot?

    What a disgrace!

It's despicable. Although I like the 287 (g) program it has to be superceded by an AZ immigration law in North Carolina and every other state along with state and local authority to deport.

Judy, I think you just stumbled onto a solution.

If states began enforcing their own new STATE immigration laws, and deporting the identified illegals to the nearest town of bordering states that DID NOT have such laws, maybe everyone could eventually get on the same page.

New STATE laws could include confiscation and sale at public auction of business property from those caught employing them, and the proceeds could be used to fund the revolving door transport each day. Eventually jobs would dry up, and the "deportees" would eventually get tired of sneaking back in only to be shipped off again. Reasonable penalties including STATE incarceration could be used to discourage repeat offenders.

Think how many jobs would be opened-up over time for state residents, and how many jobs could be created by the new STATE Department of Deportation.

The sale of seized property would generate new businesses and stimulate local economic growth. That means more jobs!

So....who wants to sign up for the new State Immigration Task Force? Will your state be first?

Fat chance that happens. A move in that direction will only serve to hasten ReConquista.

Besides, John and Jane Doe won't have the stomach for course correction. A great number of people don't even know there is a problem, much less understand it. Put a wrinkle in their otherwise blissful life of debt slavery and they will sell out their own parents or children. Haven't we seen proof of that already?

The media is part of the problem. I live in NC and this is the first I've heard of this. They try and push these stories under the table. If any of the main stream media would start telling the truth it'd be a lot easier rooting these people out.

I think if they can confiscate property when people are arrested with marijuana they can do the same with these illegal immigrants.

I just don't understand why these people get away with everything but murder.
