Currently, the states have no right to enact laws that are different from the federal law. Such as sanctuary policies. If the federal policy changes, that Plenary Powers Doctrine might be also be modified by the constitutional duty of the federal gov't to protect States from invasion. Normally the Plenary Powers doctrine would be the rule---but it is not quite at a constitutional level.

Great poll! i think absolutely the states should take charge of deportation as well. They're fully capable of determining legal status, coordinating with ICE databases and so forth, and shipping them on out. The states would get them out of here more quickly, the people would spend less time in detention, the states and local law enforcement would be able to coordinate associated deportations of family members and so forth much better and they can deport the whole family/clan/bunch whatever at the same time and do so at a much lower cost.

What most people are unaware of is the 5th revision in 1996 to the 1986 IRCA (Simpson-Mazzolli Act) gave the states the authority to carry out federal immigration laws including 287g. It also outlawed sanctuary cities making it a felony for anyone to provide sanctuary to illegal aliens.
