    The NDAA act of 2012 is not simply an authorization for military spending or force. The NDAA act 2012 authorizes the indefinite detention of Americans suspected of harboring terrorists or in any way supporting Al Qaeda. What this means is that under the NDAA 2012 law any American citizen can be arrested without a trial and held for as long as the government deems necessary.

    The most disturbing notion about the NDAA 2012 law is that the detained individuals can be American Citizens, and there is no trial required in order to justify the imprisonment. Without the protections offered to Americans under Habeas Corpus, the NDAA provision about indefinite detention is open to abuse by governmental authorities. This legislation opens the door to tyrannical abuses and violations of the U.S. Constitution.

    The proponents of this legislation proclaim that the NDAA 2012 law is necessary in order to ensure the security of the United States. In reference to Americans detained under this bill Republican Senator Lindsey Graham stated, "And when they say I want my lawyer, you tell 'em to shut up. You're an enemy combatant and we're gonna talk to ya about why you joined Al Qaeda." It is evident that the true intention of this bill is to strip American citizens of their right to a trial by jury, and not to protect us from a domestic or international threat.

    The NDAA provision that warrants the indefinite detention of American Citizens can be found in section 1021 of the bill. It warrants the detention without a trial of anyone, either foreign or American, who is suspected of helping Al Qaeda or related organizations. The problem with this idea of indefinite detention lies in the fact that the government is not always right, which has been proven time and time again with DNA evidence overturning murder convictions. If they make a mistake, or worse misuse the law in order to target political opponents, this could result in years lost in the lives of innocent idealistic Americans.

    An early example of the unjust detainment that could be perpetrated on innocent Americans with the NDAA 2012 law is the case of Brandon Raub. Raub was not arrested under the NDAA, but under Virginia State Code § 37.2-808. The statute allows the government to take into custody anyone who is suspected of having mental health issues and of being an immediate violent threat to the community. The only problem with this is that all Brandon did to supposedly warrant this detainment was post some lyrics from the rap group Swollen Members on his Facebook page.

    Raub served in both Iraq and Afghanistan as a Marine. Brandon does not own a gun, and he does not have PTSD or violent tendencies. The premise for arrest in this case was completely absurd, and this is an example of how such provisions written in the NDAA could be used to detain Americans for something as innocent as a Facebook post. If they can misinterpret a peaceful vet as a mentally unstable threat just because he holds views different than the norm, and wants to post some lyrics on his Facebook, then this type of law can be misapplied to anyone. Luckily Circuit Judge W. Allan Sharret found the order to detain Brandon to be invalid, but if this were a case of the NDAA having been applied there likely would have been no judge to determine this. With NDAA a trial is not required.

    The NDAA was signed into law on new years eve 2011. This is even more alarming when considering that Barack Obama claimed to have serious concerns about this bill. He signed it when the masses were mostly participating in festivities and not likely to be surveying the political arena. After this was signed there was a near blackout from mainstream news outlets in regards to the significance of section 1021 of the NDAA law 2012. The main reason for blacking out the truth about NDAA is that media outlets, whether they lean left or right, are subject to the same constraints as the Republican and Democratic parties. The same mega corporations fund both mainstream political parties thus they shape the political agenda set forth in Washington D.C.

    If you want to hear the truth, or really anything at all about NDAA, you have to search the alternative media sites such as RT or Infowars. Of course it is up to you to govern your own synaptic processes in relation to the NDAA 2012 law so I just linked to it in its entirety. It is essential that citizens are informed and read the bills that congress and the senate push through. Many times the congress and senate do not even read them.

    Bills can be written entirely by lobbyists or corporations that stand to benefit from them. They are worded in tricky legalese that is sometimes obscure in meaning. If I did not feel this were a very real issue today in November 2012, nearly one year later, I would not be writing about the NDAA 2012 law.

    Even today when I try to explain NDAA to friends or acquaintances, they ask me what it is. I feel this is partially my fault at one level, but at the same time it really is not. I cannot say I did not try to tell them, and it is not my fault that they care so little about current or even semi-current events. Apathy is the reckless cover perpetuated in America to justify ignorance on a mass scale, but deep down inside I cannot see how anyone can be truly apathetic about an issue of this magnitude.

    The NDAA act of 2012 has the potential to turn the U.S.A. into a truly totalitarian state not unlike Nazi Germany or Soviet Russia if it is one day misused by a despot who is elected by the unknowing masses in thrall to techniques of psywars and mass hypnosis, which many are unable to comprehend. If we allow the NDAA section 1021 to remain on the books year after year, it will be far too late when hordes of Americans are taken to forced inmate labor camps, re-education camps, or even worse death camps.

    You may think it cannot happen here. That is the illusion that is persistent in all strong and relatively free societies, and this is the very reason the evil and tyrannical are allowed to flourish. The "it can't happen here" mentality allows unjust laws to be imposed and all of our rights to be decimated under the premise of safety or security. The problem is that the lack of checks and balances in government causes less societal stability, not more. It can truly happen anywhere, and it is happening right now. It is up to all Americans to take actions that promote awareness in both a constructive and peaceful manner.

    The fight against NDAA 2012On September 12, 2012 Judge Katherine B. Forrest issued a permanent injunction blocking the indefinite detention provision of the NDAA 2012 law. This was appealed by the Obama administration. The Justice Department argued that the plaintiffs, including Pulitzer prize winner Chris Hedges, have no reason to fear detention, and that Forrest's ruling interferes with the president's powers in a time of war. The temporary freeze on the ruling was successful and the case awaits a final ruling in December 2012

    There are numerous sites where you can take action against the indefinite detention provisions of the NDAA act 2012 which include Downsize DC, Amnesty International, and P.A.N.D.A. The most important actions can be taken by the states and local communities in opposition to the unconstitutional NDAA provision in section 1021.
