I will buy #4 and #1. The other three are pipe dreams.
5. Congress does not scrutinize anything. Who's kidding who that the next time a 'mandate type tax' will be subjected to anything but the general incompetence and corruption all tax increases seem to go through. Obamacare for example.
3. Roberts set no limits on the Commerce Clause according to some legal experts. His comments were not central to the decision, and as such will not be accepted as precedence by the courts.
2. Any 5-4 ruling by the courts will be viewed as an activist court. Look at the criticism Roberts is getting from conservatives. Nothing ever shuts up roving gangs of idiots such as OWS. In fact this narrow victory for Obamacare will likely make SCOTUS appointments key campaing issues for both parties which means plenty of criticism of the conservative judges on the court as being activists.
I know many who are disappointed with the SCOTUS decision on Obamacare are trying to glean any speck of silver lining from that decision's dark cloud, but we will not gain anything by fooling ourselves. Rack one up for Obama and on to the main game in November. That is where our focus must be. That is where we can start to effectively address the major issues facing us. If we lose there, in my opinion, the SCOTUS decision on Obamacare will become irrelevant."We have met the enemy, and they is us." - POGO
