Cap and Trade, Commerce, and domestic nanny-state enemies.
We are led to believe by domestic enemies who promote Cap and Trade that Congress’s power to regulate Commerce among the States was intended to allow Congress to enter the states and regulate the manufacture, marketing, and distribution of products within the various states. But the historical evidence, during which time our Constitution was framed and ratified, establishes something far different regarding the power in question. Let us look as some irrefutable facts.
A fundamental rule of constitutional law as stated by the SCOTUS is:
“The Constitution is a written instrument. As such, its meaning does not alter. That which it meant when adopted, it means now. “___ South Carolina v. United States, 199 U.S. 437 (1905)
So, what was the meaning of “commerceâ€

I think it is important to understand how our federal government’s powers have been continually expanded beyond those granted by our written Constitution. Seems to me many current expansions of federal power are achieved by Congress passing a law “implyingâ€
