    Vote to Strip Out Military Detention of Americans Fails.

    Heavy disinformation going around that this exempts American citizens. Not true, though it is cleverly-written. In addition to Sen. Lindsey Graham saying point blank that it does include American citizens, Senior Legislative Counsel for Washington ACLU, Chris Anders, explains:
    Don’t be confused by anyone claiming that the indefinite detention legislation does not apply to American citizens. It does. There is an exemption for American citizens from the mandatory detention requirement (section 1032 of the bill), but no exemption for American citizens from the authorization to use the military to indefinitely detain people without charge or trial (section 1013 of the bill). So, the result is that, under the bill, the military has the power to indefinitely imprison American citizens,

    It defines anyone classified as an enemy combatant as being subjected to the terms of indefinite detention and being tried outside of criminal law as in military tribunals. As argued IF a terrorist were to make it onto American soil and then be captured they would be subject to civilian criminal law as opposed to be classified as an enemy combatant captured behind lines. This in effect removes American soil from the context of the battlefield. It does have implications of compromising National security as anyone tried in a civilian court is subject to public scrutiny. Tactical and operational secrets could be compromised if prosecuted in this manner. Take the Issue of KSM. Other than personal security issues and the possible retaliation against NY if he was prosecuted in civilian court , issues of national security were at the forefront of the decision not to pursue this course of action.


    Perfect example was the recent killing of Shiek whatever his name was , that was killed in Yemen in the drone attack. He was a U.S. citizen. Had he come home to visit family for Christmas ,,, he would have been captured and he could have fallen under this law.

    Won't this also mean that they can apply this to any American citizen that they deem to classify as a domestic terrorist, much like the leaked DHS documents that profile tens of millions of Americans like as suspect domestic terrorists?

    I guess this whole provision would apply to 'suspected terrorists' since it implies no trial or official ruling of a judicial body as to guilt or innocence.

    If this is the case, then America has just entered a new more dangerous phase of dictatorial rule.

    No surprise that compromised traitor Lindsay Graham is supporting it.

    He probably fantasizes about paying me visits in my cell one day.

    Looks like libs are against it and conservatives are for it. makes me suspicious of anything the libs support. Tried to look up text of the actual bill but had no luck. Must be one of those things we have to vote for to find out what is in it?

    McCain is a strange one. He has done some very good things and then again he has taken some very ignorant and stupid positions. Possibly because of his history he places too much faith and confidence in his government to do the right thing? There should be a way to protect national security and the American People at the same time. We do not want Islamic radicals tried in civilian courts for obvious reasons , no matter where they are caught.
