Tell Congress to Reject New & Harmful Online Tax Legislation

The House of Representatives is once again considering legislation that could unfairly impose burdensome compliance requirements on Internet-enabled small businesses and entrepreneurs. Like its predecessor the Marketplace Fairness Act, the Remote Transactions Parity Act could require small online retailers to adhere to tax laws in more than 9,600 tax jurisdictions, thereby subjecting small businesses to audits and enforcement by far-away state tax enforcement agencies. These requirements impact the competitiveness of small businesses by holding them to the same tax burden standard as large retail businesses that have facilities across the country and teams of lawyers and accountants.

I am asking you oppose the recently-introduced Remote Transactions Parity Act, legislation that would stifle business growth and hurt consumers.

Like its equally-damaging predecessor the Marketplace Fairness Act, if the Remote Transactions Parity Act is passed into law, it will:

- Require small business owners to collect and remit sales tax to every remote jurisdiction across the country, regardless of physical location. With over 9,600 tax jurisdictions across the country - which all have their own unique rates and rules - this will be a crippling compliance burden for small businesses.

- Give remote states across the country new authority to subject businesses with no in-state presence to audits - a highly expensive, time-consuming, and distracting process that could prevent many small businesses from growing and continuing to help their local economy.

- Discourage the use of technology for small businesses looking to grow. The Remote Transactions Parity Act would hold small Internet-enabled retailers to new and higher tax standards, relative to brick and mortar stores that are responsible for only one tax jurisdiction.

Additionally, this legislation disqualifies any small business using an online marketplace from the already weak small seller exemption in the bill. This is discriminatory and will discourage small businesses from using online marketplaces that allow them to grow by reaching new markets and new customers.
