WASHINGTON – With the U.S. Food and Drug Administration scheduled to begin nationwide delivery this week of swine flu vaccine to 90,000 government-approved locations, attorney James Turner filed a complaint Friday in federal court in the District of Columbia for a Temporary Restraining Order to halt the distribution, licensing and use of four controversial vaccines -- including their use under an existing Emergency Use Authorization (EUA) -- until there has been adequate safety testing and a full opportunity for public hearings.

The suit challenges the Sept. 15 licensing of four swine flu vaccines, alleging that the FDA violated the law in its hurried approval by failing to determine the safety and efficacy of the vaccines as required by law since 1964.

Turner told NewsWithViews that none of the procedures that should have been done, and that make up a formal administrative record, had been done.

“Our argument is that they’re required to follow the law that says how you determine something is safe and effective,â€

To date, the FDA has produced absolutely no scientific evidence documenting safety tests for any of these swine flu vaccines. There are no published studies, no records of any clinical trials, and no publicly-available paper trail demonstrating that any safety testing was done whatsoever. There is no researcher who has publicly put their name on the record declaring the vaccines to be safe, and no FDA official has ever stated that scientifically-valid safety testing has ever been conducted on the vaccine / adjuvant combinations now being distributed across America.

I want to know if these claims are accurate immediately. Will anyone take this on and research this for us?

Several nurses are suing the state of New York to protect themselves from mandatory swine flu vaccinations
– saying threats of being fired for refusing shots violate their civil rights.

Albany Medical Center nurses face a week of suspension without pay and termination if they don't accept both the H1N1 and seasonal flu vaccinations by Oct. 27.

According to a New York mandate, all health-care workers must be vaccinated by Nov. 30.

But the four nurses argue that proper hygiene – such as washing hands and covering mouths and noses when coughing and sneezing – is an equally effective method for combating the flu. They also expressed concerns about possible side effects of the H1N1 vaccine.

"I have had more staff that have become ill after the flu vaccines this year than co-workers that have actually come down with the illness," Lorna Patterson, one of the nurses, told Albany's WTEN-TV.

She said she believes more time is needed to learn about the vaccine's effectiveness. Patterson, a nurse for 28 years, said she hasn't receive the flu shot since she was a teenager.

Patterson's co-worker, nurse Katheryn Dupuis, said she's only received a flu shot once in her 10-year career as an emergency room nurse.

"We're going to lose our jobs if we do not get this vaccine," Dupuis said. "There are hundreds of co-workers of ours that feel just as strongly against the vaccine."

The nurses are collecting signatures on petitions to area hospitals and health-care providers. They have at least 500 signatures on one, and several others are circulating through the community. They have also scheduled a protest at the capitol Wednesday at 1 p.m.

According to Albany's WRGB-TV 6, the group is concerned that pharmaceutical companies have been given immunity in case complications from the vaccine arise.

The nurses plan to file their lawsuit against state Health Commissioner Dr. Richard Daines in New York Supreme Court by the end of this week.

The Department of Health says it will vigorously defend itself in the lawsuit, and health officials are confident the regulation will be upheld by the court, WXXA-TV 23 reports.

But Patterson and Dupuis said they will retire or find nursing positions outside of New York if the state doesn't withdraw its mandate.

"I don't think anybody wants to achive that kind of result," their lawyer, Terry Kindlon, told WTEN. "The health-care workers are being stampeded into this, and we're supposed to be a thoughtful, rational society that deals with things through due process and careful reflection. That's not what [New York] wants them to do here.

"They're saying, 'Look you guys, get the shots or in the next two weeks, you're on the street.' That's criminal. That's ridiculous. That's insane."

Aother lawsuit filed in New York City against Daines and Jeffrey Kraut, chairman of the state Hospital Planning and Review Council, argues that the state does not have the authority to mandate vaccines.

Kindlon said other lawsuits are arising throughout the state, and the New York Civil Liberties Union may file a legal complaint in coming weeks.

With hundreds of millions of Americans potentially being targeted with this vaccine, the potential for improper mixing, improper dosages, and human error is alarming.

If the charges described in the lawsuit are true, it means the FDA has blatantly abandoned medical science and violated its own regulations in approving not only these four vaccines, but the potentially deadly adjuvant chemicals as well. "What has been tested?" asked attorney Jim turner. "Where has it been tested? Who reviewed the test? Who looked at the test and said yes they proved safety and efficacy? There is no record that we can find that shows these things have been done."

By approving the four vaccines in the absence of such safety testing, the FDA itself stands in direct violation of federal law. "There is a law that they're supposed to follow and they are not following it," Turner added.


Billions of dollars are at stake
Why, then, did the FDA apparently violate the law and push these vaccines into full public distribution without securing the safety testing required by law? Turner suspects a profit motive may be involved: "They're charging $24.95 to get a vaccine. Multiplied by 100 million people, that's a lot of money. If you do the whole society, you're talking about several billion dollars."

Thimerosal is the preservative of choice for vaccine manufacturers. First introduced by Eli Lilly and Company in the late 1920s and early 1930s, the company began selling it as a preservative in vaccines in the 1940s. Thimerosal contains 49.6 percent mercury by weight and is metabolized or degraded into ethylmercury and thiosalicylate. I thought that the Director of Homeland Security, Janet Napolitano, just could not get any more incompetent. I was wrong. Her latest attempt at controlling the potential swine flu epidemic is classic bungling. Her suggestion that those in Mexico use ‘personal responsibility’ in not spreading the disease is moronic at best. How can they use ‘personal responsibility’ if they are breaking our laws coming into the U.S. in the first place? Not to mention the multi-day incubation period while they do not even know that they are carrying the disease. Good move, barry, on tapping Napolitano for DHS. Good GOD, man! WHAT IN THE HELL WERE YOU THINKING! Or not?
