An Albuquerque man with 127 arrests under his belt was back in court Tuesday as prosecutors fought to put him back in jail after violating the conditions of his release.

The District Attorney’s Office is asking to increase the bond for Kevin Garner or tighten the conditions of his release in hopes that either would encourage Garner to stay out of trouble.

Garner was released after he was arrested in March on drug trafficking charges only to be arrested again in November for the 127th time for assault and drug possession.

During Tuesday’s court appearance a judge denied the DA’s request to increase Garner’s bond but agreed to change the conditions of his release requiring Garner to check in regularly with a probation officer.

Garner was also ordered to take a drug test Tuesday and if any drugs are found in his system he could go back to jail.

Garner’s attorney Tim Padilla tells KOB Eyewitness News 4 that his client is being unfairly picked on by police.

"What they have against him is a lot of allegations, which a lot of that stuff shouldn't even be brought. It will ultimately play out,â€
