    H-2B Temporary Non-Agricultural Workers

    Alert: USCIS is no longer accepting petitions filed under the temporary final rule (PDF) increasing the FY 2018 numerical limit on H-2B nonimmigrant visas. USCIS will reject and return any petitions received after June 6, 2018 that were not selected in the lottery, as well as any cap-subject petitions.

    Petitions accepted for processing will have a receipt date of June 11, 2018. Premium processing service for these petitions begins on that receipt date. Only employers whose petitions were accepted will receive receipt notices.


    USCIS continues to accept H-2B petitions with start dates for FY 2018 that are exempt from, or not counted towards, the congressionally mandated cap. USCIS will consider petitions requesting an employment start date on or after Oct. 1, 2018, towards the FY 2019 cap. These petitions will be subject to all eligibility requirements for FY 2019 H-2B cap filings.


    The H-2B program allows U.S. employers or U.S. agents who meet specific regulatory requirements to bring foreign nationals to the United States to fill temporary nonagricultural jobs. A U.S. employer, or U.S. agent as described in the regulations, must file Form I-129, Petition for Nonimmigrant Worker, on a prospective worker’s behalf.

    Period of Stay

    Generally, USCIS may grant H-2B classification for up to the period of time authorized on the temporary labor certification. H-2B classification may be extended for qualifying employment in increments of up to 1 year each.

    A new, valid temporary labor certification covering the requested time must accompany each extension request. The maximum period of stay in H-2B classification is 3 years.


    A person who has held H-2B nonimmigrant status for a total of 3 years must depart and remain outside the United States for an uninterrupted period of 3 months before seeking readmission as an H-2B nonimmigrant. Additionally, previous time spent in other H or L classifications counts toward total H-2B time.


    Exception: Certain periods of time spent outside of the United States may "interrupt" an H-2B worker's authorized stay and not count toward the 3-year limit. See the Calculating Interrupted Stay for H-2 Classifications Web page for additional information.

    Every year, the U.S. companies are allowed to import 66,000 low-skilled H-2B foreign workers to take blue-collar, nonagricultural jobs. The H-2B visa program is used by businesses to bring in cheaper, foreign workers and has contributed to Americans having their wages undercut.

    After staunch lobbying from the big business lobby and business-first Republican lawmakers, Nielsen announced the decision in a statement, justifying the importation of more foreign workers as a necessity in order to help businesses that are “at risk of failing.”

    Nielsen said:

    The limitations on H-2B visas were originally meant to protect American workers, but when we enter a situation where the program unintentionally harms American businesses it needs to be reformed.

    I call on Congress to pass much needed reforms of the program and to expressly set the number of H-2B visas in statute. We are once again in a situation where Congress has passed the buck and turned a decision over to DHS that would be better situated with Congress, who knows the needs of the program.

    As Secretary, I remain committed to protecting U.S. workers and strengthening the integrity of our lawful immigration system and look forward to working with Congress to do so.

    Nielsen’s ability to expand the H-2B program is a gift to business provided in the 2018 omnibus by retiring House Speaker Paul Ryan.

    The 2018 omnibus — like the 2017 omnibus — did not require legislators to vote for expanding the unpopular program. Instead, it allowed DHS to raise the caps.

    The decision to bring more low-skilled foreign workers to the U.S. undermines President Trump’s “Buy American, Hire American” executive order. This is now the second consecutive year that DHS has caved to the big business lobby and allowed 15,000 foreign workers to take U.S. jobs.

    Though the business community — with the help of the establishment media — has relentlessly warned of so-called “labor shortages,” wage data analyzed by the Bureau of Labor Statistics, Center for Immigration Studies (CIS), and the Economic Policy Institute crushes these claims.

    For example, data has shown that wages for Americans have actually declined in the majority of H-2B visa occupations. Researchers say the H-2B visa program allows businesses to keep a steady stream of cheap, foreign workers in order to avoid raising U.S. wages and recruiting Americans for the blue-collar jobs.

    The H-2B program is just another venue for businesses to undercut wages for jobs American will actually do. Trump was big on his campaign about 'hiring American and buying American' but in reality, that was just another one of his campaign promises he knew would appeal to the American people. In other words, he didn't necessarily mean what he was saying, not fully ... his actions are a clear signal of that.

    Since becoming President, Trump he has allowed (and probably encouraged) DHS to raise the H-2B cap two years running. The 2018 increase over the 66,000 cap was larger than the 2017 one. Certainly leaves one wondering where this is going. Speaker Ryan is a huge supporter of more foreign labor, so the Trump administration gave him exactly what he wanted with the H-2B increases.

    So, Nielsen raised it, but then she wants Congress to take over the responsibility of raising it so Nielsen and Trump won't get the blame for it. Much the same way Trump wants Congress to pass an amnesty, and then he will wiggle out of any responsibility for that and blast away at Congress for doing so. At least some of us are wise to their tricks and maneuvers.

    Thousands of Puerto Rican's here that NEED jobs! WE are footing the bill for their FEMA housing and hotels. They need to be placed in these Foreign Work Visa jobs OVER bringing more people here!

    I do not want to pay for PR's welfare, food stamps and housing.

    Get a list of those people not working and place them in a JOB!
