O.C. ‘birther’ sues to block primary election results

Laguna Niguel attorney Orly Taitz has filed suit to block California’s 2012 primary election results, alleging “rampant election fraud” in general and “identity fraud” by candidate Barack Obama specifically. A hearing is scheduled for Friday to hear her request for an emergency stay, according to the Orange County Superior Court’s website.

Taitz, who’s gained a national reputation for a series of failed lawsuits alleging that Obama is not a natural-born citizenship, has a second objective in this lawsuit as she was a failed candidate for U.S. Senate. She alleges some voters seeking to cast ballots for her were unable to do so, and that people using the names of those born in 1850 are casting ballots.

The Republican Taitz finished fourth in a field of 24, failing to make November’s top-two runoff. She received 152,298 or 3.2 percent of the vote. The top vote getter, Democratic incumbent Dianne Feinstein, got 2,356,559 votes, and the second-place finisher, Republican Elizabeth Emken, got 604,910 votes.

Feinstein, Emken and Obama are all named as defendants in the suit, although there are no specific claims of wrongdoing by her fellow Senate candidates.

Taitz says she’s found a married couple who were prevented from voting for Taitz. (The new open primary system means all candidates are listed on all ballots.) She also alleges the voter rolls “are full of the names of voters” who were listed as being born in 1850 and are still casting ballots. She calls for a special prosecutor to investigate “rampant voter fraud.”

She also alleges that Obama’s birth certificate is forged and so he is ineligible to run for president. Taitz had previously said that electronic ballot counting machines may have been rigged against her.
