A woman is facing up to 20 years in prison for “tampering with a consumer product” after a video of her opening a gallon of Blue Bell ice cream, licking it, then putting it back into the grocery store freezer went viral on social media.

According to Blue Bell, staff recognized where the “malicious act of food tampering took place.”

Blue Bell said they removed all the “Tin Roof” gallons of ice cream from the freezer of the San Antonio Walmart “out of abundance of caution.”

“The safety of our ice cream is our highest priority, and we work hard to maintain the highest level of confidence of our customers,” Blue Bell said in its statement. “Food tampering is not a joke, and we will not tolerate tampering with our products. We are grateful to the customers who alerted us and provided us with information.”

Police are confident that they have identified the woman from surveillance video and will be issuing an arrest warrant shortly.

NBC Dallas reported:

Blue Bell inspected the freezer where the licking incident took place and said it believes it located the half gallon of Tin Roof that was “tampered with,” the statement said.

She could face a second-degree felony charge of tampering with a consumer product, the Lufkin police department said in an email statement to NBC News. The charge comes with a two- to 20-year prison term and up to $10,000 in fines, according to Texas state penal code.

Investigators are also in discussions with the FDA and additional federal charges could be made.

It is nasty, prison is pretty harsh. But she could have Hepatitis, AIDS, TB, any number of infectious disease spread through bodily fluids. That should not be taken lightly. What if she has Herpes on her lips?

She should be tested for ALL of it.

Another woman was arrested this week for urinating in an ice cream bucket, picking her nose and touching it, then spitting on ice cream.

A 66-year-old Florida woman was arrested on Monday and charged with criminal mischief and tampering with consumer products after she was caught tampering with an ice cream store’s products, forcing the store to close for days.
USA Today reported:

St. Petersburg resident Jung Soon Wypcha, 66, was charged with criminal mischief and tampering with consumer products Monday after sullying about $2,000 worth of ice cream at Lu Lu’s Ice Cream shop in Indian Shores, Florida, according to the arrest affidavit sent to USA TODAY by the Pinellas County Sheriff’s Office.
Wypcha was caught on video after authorities reviewed the store’s surveillance tapes, which showed her tainting the store’s merchandise on several different occasions beginning June 17.
The affidavit said there were five incidents of Wypcha using the bathroom that her business shared with the ice cream shop, with the door wide open, and then putting her hands in the containers of ice cream without washing her hands.

The woman said it was a staged prank on her Instagram account.

BELLE ROSE, La. (WAFB) - Law enforcement has had enough. In the weeks after a viral video of a young woman taking the lid off a Blue Bell container, licking the ice cream, and putting it back in the display case, videos of copycats doing the same thing are now making the rounds on social media.

The Assumption Parish Sheriff’s Office says Lenise Martin III, 36, has been taken into custody after being filmed in a store licking a Blue Bell ice cream container, moving his finger through the container, then putting it back onto the shelf.

Investigators say after management became aware of the video, Martin returned to the store and showed the clerk a receipt to prove he’d purchased the ice cream.

Management at the store later alerted investigators who questioned Martin.

Deputies moved forward with charges, including unlawful posting of criminal activity for notoriety and publicity, and tampering with property. Martin remains in jail and will have bond set by a judge Monday.

“We discourage anyone from copying this atrocious act,” said a spokesman for the Assumption Parish Sheriff’s Office. “It is illegal. It’s a health risk to others. We will pursue anyone we see do this. You will be charged.”

The spokesman also said notices have been sent out to investigators informing them that copy cat cases should be dealt with “immediately and with the full extent of the law.”
