Texas Warns Obama to Back Down on Plot for “Illegal” Land Grab

    Written by Alex Newman

With the public already steaming over the increasingly lawless and out-of-control federal government, top Texas officials on both sides of the aisle were quick to react after recent reports suggested the Obama administration’s Bureau of Land Management was plotting yet another unconstitutional land grab. This time, the BLM is reportedly eying some 90,000 acres along the Red River on the Texas-Oklahoma border. From the governor’s office to the attorney general to the legislature, however, the message from Texans was loud and clear: “Don’t Mess With Texas.”
Already facing nationwide outrage and criticism over its extreme tactics at the Bundy ranch in Nevada, the BLM, of course, was quick to deny the reports — sort of. It issued a dubious statement claiming that the administration was not actually planning any more new heists. “The BLM is not — I can say categorically — not seeking to seize any privately held land along the Red River,” bureau “Public Affairs Specialist” Paul McGuire was quoted as saying, with the double-negative presumably unintentional.
However, there are some caveats, it seems. According to news reports, the BLM claims that even though citizens have been buying, selling, and using certain lands between the middle of the Red River and its south gradient bank, that area is not in fact private property. A 1988 court ruling against a landowner there, in which he lost a significant chunk of his property to authorities, apparently gives the federal government “precedent.” No “comprehensive land survey” by the BLM has yet been performed, officials said, but agency is now taking some “initial steps.”

The BLM claims that it is simply creating a “resource management plan” while engaged in a broader, multi-state “review” of the lands it claims to own. It is also working to help determine the boundary between supposed “federal” land and private property. “What we are trying to do,” the BLM “public affairs specialist” claimed, “is to determine how and whether these lands can be managed for the benefit of the American people.” That language alone, though, sparked more alarm.
Either way, at the highest levels of state government, Republican and Democrat officials across Texas indicated that they were not buying the BLM’s denials. Top Lone Star State leaders also said it appeared that the federal agency was threatening private-property owners in the region by claiming ownership over private land that has been owned, maintained, and cultivated by Texans for generations. Responding to the reports of more potential land grabs, top officials promptly put their foot down.
“It’s not a dare, it’s a promise that we’re going to stand up for private property rights in the state of Texas,” Republican Gov. Rick Perry told Fox News, adding that the federal government was “out of control” and would be resisted in the Lone Star State if it tried to steal more private property. “The federal government already owns too much land.”
Gov. Perry’s deputy, meanwhile, went further, accusing the administration of flaunting the law in its mad grab for more land and power. “The federal government's history of arrogant overreach is approaching a new low with the Bureau of Land Management's threat to confiscate up to 90,000 acres of Texas land,” Lt. Governor David Dewhurst said in a statement, calling for a lawsuit to stop the BLM’s “illegal” abuses. “This outrageous, illegal act makes my blood boil as it should for every Texan who believes in the sanctity of private land ownership.”
It is not the first time, though, that Texan landowners have been abused by the BLM. “This is a federal land-grab, pure and simple and the BLM has done it before,” Dewhurst continued, referencing the agency’s seizure of another landowner’s property on the Red River some 30 years ago. “Taking private property away from Texas families, who in some cases have paid taxes on the property for over 100 years since they assumed ownership from the State of Texas, is entirely unacceptable.” Like other prominent elected officials from Texas, Dewhurst, a former Texas land commissioner, has also called for Obama to be impeached.
Liberty-minded Texas Attorney General Greg Abbott, who is also the front-runner in the race for governor and has earned a national reputation for standing up to federal abuses, offered the most forceful rebuke of the BLM so far. “I am about ready to go to the Red River and raise a ‘Come and Take It’ flag to tell the feds to stay out of Texas,” the popular figure told Breitbart Texas in one of a series of powerful public statements in the media warning the administration not to mess with Texas or Texan property owners.
“This is the latest line of attack by the Obama Administration where it seems like they have a complete disregard for the rule of law in this country,” he added. “And now they’ve crossed the line quite literally by coming into the State of Texas and trying to claim Texas land as federal land. And, as the Attorney General of Texas I am not going to allow this.” In an interview on Fox News, Abbott also threatened to battle the BLM in court if needed, expressing optimism for success.
Separately, in a stinging letter to BLM boss Neil Kornze — a former staffer for scandal-plagued Sen. Harry Reid (D-Nev.) — Abbott demanded to know what the agency was thinking. “I am deeply concerned about the notion that the Bureau of Land Management believes the federal government has the authority to swoop in and take land that has been owned and cultivated by Texas landowners for generations,” he wrote, asking a series of questions that the BLM chief must respond to.
“The BLM’s newly asserted claims to land along the Red River threaten to upset long-settled private property rights and undermine fundamental principles — including the rule of law,” the attorney general added in his letter. “Yet, the BLM has failed to disclose either its full intentions or the legal justification for its proposed actions. Decisions of this magnitude must not be made inside a bureaucratic black box.”
In a strong show of bipartisanship, even the radical Democrat candidate for Texas governor, Wendy Davis, blasted the BLM machinations. “Wendy Davis strongly opposes any potential seizure of private property” from Texans to the BLM, declared a statement released by her campaign communications director. Other Democrat lawmakers in Texas have gone even further, pushing for a bipartisan review of the federal government’s anti-property rights machinations in the next legislative session.
On the ground along the Red River, Lone Star State landowners, too, have expressed alarm. In a phone interview with The New American, property owner and rancher Scott Carpenter of Nocona, Texas, warned that Americans should stand up against the BLM and the harm it is doing. “At this moment, we are not in the 116-mile stretch, it’s 20 miles from us, but if this would take place, it would set precedent and they could just continue down river,” he said. “If they’ve already sunk their teeth in, what would stop the government from coming in and taking our property, too, so we’re in danger also.”
Carpenter said the federal agency, which many critics argue is not authorized by the Constitution and is therefore unconstitutional, has been operating in a bizarre and suspicious manner in the region. “The BLM has yet to come out and say what exactly their plans are for using this property,” he said, praising Texas’ elected officials for immediately stepping in to protect the people and their rights. “They are being very tight lipped about this, very cloak and dagger about it.”
While he is not yet sure what the BLM is plotting, “obviously it’s not for hospitals and highways, it’s just a land grab. I don’t know, maybe they’re after land rights, water rights, or mineral rights, too.” He said a lot of the land the BLM appears to be eying “for their overreaching” has “been in these families for generations.” It is even bigger than that, too.
“It’s more than just a loss of acreage. It’s a loss of food, of revenue to the producers; then you lose tax base for local schools and county governments, and that means fewer jobs for teachers, fewer jobs for everybody,” he said. “The whole economy will suffer — if there’s not as many dollars, not as many people, that affects everyone.”
It is time for people to do something about it, though. “I believe the American people are tired of our government — especially this administration — constantly overreaching,” Carpenter continued. “Private property rights being taken away, now the EPA has changed the Clean Water Act to take more control of our land; it’s always more and more regulations — and they just won’t stop.”
The rancher said other states should look at how Texas has responded when the federal government tries to overreach. “We don’t have to lay there and play dead and just accept whatever they’re wanting to do to us,” Carpenter concluded. “We need to work together. We live in a free country. We have to use our ability to vote to put leaders in office who have the same mindset as we do as Americans.”

See the difference? If not let me break it down for you. Pic on the left, you are a subject and the government does not fear you in which they will treat you as they wish which is usually BAD! Pic on the right, you are an armed citizen which your government is forced to respect or fears bloodshed and revolution. Take your pick. I choose to side with those in the pic on the right!

BREAKING: Feds Threaten to Steal Texas Land… Texas Responds

Texas is a proud state, and it’s citizens are generally a proud and independent people, with little love or regard for the federal government or it’s agents and bureaucrats from DC.

Governor Rick Perry has encouraged the states to fight back against federal government overreach. Senator Ted Cruz has told President Obama and his administration to stay out of Texas and leave Texans alone. The Texas Lt. Gov. has called for Obama’s impeachment.

Representative Steve Stockman has also called for Obama’s impeachment, along with Attorney General Eric Holder. With regards to the recent armed standoff in Nevada between a rancher and the Bureau of Land Management, Stockman has cited specific sections in the US Code which he says made the BLM’s militarized actions illegal.

Now Texas is fighting the BLM themselves, as the federal agency is attempting a blatant land grab along the border between Texas and Oklahoma. Texas Attorney General Greg Abbott challenged the BLM to “come and take it“, and Lt. Governor David Dewhurst released a statement on his website decrying the potential land seizure that the BLM is threatening.

“The federal government’s history of arrogant overreach is approaching a new low with the Bureau of Land Management’s threat to confiscate up to 90,000 acres of Texas land,” said Dewhurst. “This outrageous, illegal act makes my blood boil as it should for every Texan who believes in the sanctity of private land ownership.”

In 2000, while serving as Texas Land Commissioner, Dewhurst signed the Red River Boundary Compact, essentially resolving the long-running dispute with Oklahoma over the definition of the border between the two states. The 106th Congress, through House Joint Resolution 72, granted its consent to the Red River Compact and the new Texas-Oklahoma boundary it established, effective August 31, 2000.

At issue still is the definition of the boundary as the southern vegetation line, which shifts as the river’s course changes over time. According to Dewhurst, it is illogical to argue the boundary between Texas and Oklahoma, the southern vegetation line, can move south as the river’s course changes, but can never move northward. Unfortunately, the BLM, with a heavy hand characteristic of the federal government, has argued that deeds and patents to some 90,000 acres were awarded at a time the State of Texas had no legal right to do so.

“This is a federal land-grab, pure and simple and the BLM has done it before, some 30 years ago when they took 140 acres from Tommy Henderson, a proud Texas landowner,” said Dewhurst. “Taking private property away from Texas families, who in some cases have paid taxes on the property for over 100 years since they assumed ownership from the State of Texas, is entirely unacceptable.”

Once again, the federal government is overstepping it’s authority. Not only does the BLM have no claim to the land they intend to seize, they have no reasons to seize it either. This is private land owned by private individuals in Texas, not public land owned by the state or under federal management.
As people witness the heavy-handed tactics and outright land grabs of federal bureaucracies and agencies, like the BLM, more and more are of the opinion that such bureaucracies and agencies have outlived their usefulness and are no longer necessary. At the very least, agencies like the BLM need to take a step back and ensure that anything they plan to do is fully and wholly within the law, and all other options short of their involvement have been exhausted.

Eminent Domain: Andy & Ceil Barrie Find Out Their Land is Theirs, But Only Until the Government Wants it
    Daisy Luther 18 hours ago

You do your research and you choose a retreat property far off the beaten path. You spend time and money developing it, making it your own. Maybe it is a vacation home, or maybe you’re a prepper and this is your bug-out location. Regardless of the reason you chose it, it’s yours, so maybe you plant some perennial vegetables and some fruit trees. You dig a well or locate a spring. You make it your own.

Then the government comes along and says, “Nope, we want this land – you’re out.”
And they just take it, evicting you like they are the landlord and you are merely a tenant, despite your name on the deed.
That’s exactly what happened to a couple in Colorado. Andy and Ceil Barrie fought the government and the government won.

The Barries had purchased and idyllic 10 acre parcel of land in the midst of the White River National Forest. The private land had on it a rustic cabin, an outhouse, and an old boarded-up gold mine. It was a day use cabin, and therefore totally off the grid. No electricity, no plumbing – just peace and solitude, accessible only by an ATV via a road that Summit County didn’t even know existed. The cabin is 1.2 miles off the main road. From a preparedness standpoint, the place is what most of us dream of – a sweet little piece of paradise far off the beaten path, without a powerline in sight.
The government used many different bizarre strategies to get the Barries off of their land. Pay close attention, because precedents are being set that could affect hunters or those creating bug-out retreats.

#1 ATV access threatened an endangered species
The government’s first line of attack against the Barries was forbidding them to use a motorized vehicle to reach the property. This will sound familiar to anyone who has been following the Cliven Bundy case in Nevada: Summit “county officials issued a report that stated “public motorized access” to the property threatened the alpine tundra and the habitat for the lynx, an endangered species.” (source) County officials took a vote in October of 2013, and in order to save the lynx threatened by the Barries’ occasional access, agreed that their property should be seized. (In the case of the Bundy ranch, his cattle were massacred by the government while they claimed to be concerned about the fate of the desert tortoise.)

#2 The county demanded that “various commercial activities” be halted
And exactly what nefarious money-making schemes were the Barries up to? Why, Andy Barry had the audacity to gather up fallen pine cones and take them home for his Christmas wreath making business. He used a cart attached to the afore-mentioned ATV to take them back to his home, where the wreaths were created.

#3 The county condemned the cabin because of electrical and plumbing issues
Umm…it’s an off-grid cabin, so there was no electricity and no plumbing to start with. In their haste to protect the environment, one would think that bringing in electricity or plumbing would be far more of an issue than a low-carbon-footprint place that used no public utilities. This was strictly a day-use cabin, thus requiring no plumbing or power. How many off-grid homes that adjoin national land exist across the country right now? How many hunting and trapping cabins are snugly sitting out there in the wilderness? Are all of those properties next on the government’s list of properties to steal?

#4 The cabin was in violation of zoning laws
A previous owner had expanded the cabin without a permit. Because we have to ask the government’s permission for everything, you see.
In the end, the government won.

On Thursday, the Barries had no option but to cede the land. They did not have the money to fight against the bottomless coffers of the government. They were paid $115,000 for the land. The couple had spent $75,000 waging a legal defense. Ceil Barrie said in a statement:

“The cabin was condemned on the grounds of plumbing and electricity, when it doesn’t even have plumbing or electricity. All those things added up in my mind. This is ridiculous, we can never win and our money is not unlimited. I have two kids in college this year. To me, what just came out of it is, you can’t fight the government.” (source)

The moral to this story is, the government does not support the lifestyle to which many of us aspire. Self sufficiency and freedom from the grid are not celebrated, but demonized. The government, through various agencies masquerading as do-gooders, have waged war on woodstoves, off-grid lifestyles, front yard vegetable gardens, and anything that might allow you to live without their daily input or without being subject to their many taxes and fees.
Private property rights are ignored and according to the government, we must all submit to their “eminent domain”. What it boils down to: You might think you own something, but it’s clear that it is only yours until the government decides that they want it.

Grave Times. Local Militias Taking Their Responsibilities Seriously.

    By Clash Daily / 27 April 2014

    by Matthew Dec
    Clash Daily Contributor

Beyond a shadow of any doubt, the vast majority of Americans are fed up with the current State of the Union. In April of 2013, a poll performed indicated that 29% of Americans believed that an armed revolution might be necessary within the next few years; and in the last 15 months that number most likely has escalated dramatically.
So, let’s turn this column into a “think tank.”
The question is, Where do you stand? If in a power grab, Obama incited a race war or a mass form of “terrorist attack” fueled by foreign insurgents and federal “covert actors” controlled by the Muslim Brotherhood operating out of the Homeland Security, and We the People were forced to go to war with federal mercenaries in defense of our Constitution; of what side of History would you be on? And even more importantly, once the Militia has victory, who would be in charge of them?
These are very important questions lest as History doth testify, an emperor dethroned can most certainly create a void for a new form of tyranny. Also, another question that arises is, How do we support and finance such a venture unseen since this nation’s inception?
To begin with, let’s assume that you favor the idea of a governmental overhaul; the question then arises, How do you show your support of the movement in the face of a “media” that states otherwise? The elites have most certainly ensured that cable TV time’s costs exceed the pockets of the general and loosely united populace; and they most certainly possess the “air” that we are not intelligent nor brave enough to show that we stand united.
Recently I conversed with an officer from the Florida state militia who informed me that various state militias are taking turns guarding the Bundy ranch much as active soldiers do on deployment; and that various other militias are monitoring the Red River region between Oklahoma and Texas that the feds are looking to grab and take by force if necessary.
Make no mistake about it, the traitors in DC are so up to their necks in corruption ranging from drug running to murder that they dare not turn from Agenda 21 lest their deeds be revealed by foreign insiders leading the project. If you think the Bundy standoff created a “stalemate,” think again; the feds are already planning a major psych op against the American people to turn them against the “We the People” and instill an allegiance to the prince born in Africa-raised in Indonesia- and inserted by the UN for an all out takeover beyond every national park that was given them in 1971.
From the NY Times manipulation of Mr. Bundy’s words to the reputed to be instigated “Summer of Rage” designed to further polarize for a martial law initiation; We the People MUST create a “mainstream media” of our own. With an estimated 50,000 members of We the People mobilized, the Militia Today is a rapidly growing positive influence that must be nurtured and evangelized.
And so we come to this plan of action: We are creating a website designed to create for We the People a manner to separate the civil powers of the Militia Today from the military aspects required to stand our ground in maintenance of our Constitution and National Sovereignty. But, like our military in foreign lands need support, so do our brothers and sisters who serve in “Armed Rapid Response” teams who are defending your Constitutional Rights, National Sovereignty, you and your neighbors, as well as the future of your children.
Although several pages are already created as a temporary “outpost” until a more skilled individual can be found to complete and maintain, it is far from finished and will sport the following applications:
1- A Web TV software is being installed that will host (as is to be negotiated with the current militia at the Bundy ranch) as a premier a realty show similar unto Duck Dynasty but will feature the men and women volunteering to guard the ranch as pertaining their personal reasons and daily life in expectancy of an armed assault upon the compound. It will also feature other activities, such as the Militia buildup around the Red River, and various other as created features such as training and prepping, etc…
The show will also premier a “new” form of “preaching” we call Political Evangelism which will be uniform unto the Black Robed Regiment of the American Revolution; a series entitled What People Really Think which will poll people about various issues; and an online debate platform for a third political party entitled “13 Candidates” which will vie for election among Independents.
Although time and space prevent an exhaustive expose thereof, you are encouraged to view the site (www.militiatoday.com) and purchase the only item currently available which is an Ebook entitled Mysticism in Politics, Religion, and the Occult in exchange for a $13 donation to this cause. If the Spirit doth enable you to see the vision, and you are prompted to assist, then please contact me at asrpcp@netzero.com and I will personally respond. Those that cannot afford $13 nor are able to assist with technical aspects are asked to present your ideas on how we may further the agenda on this forum.
Where there is no vision, the people perish… Prov. 29:18

Texas Attorney General Tells Feds They’ll Have to Take Land by Force

Posted on April 26, 2014 by Dave Jolly File

In another attempt to steal land from American citizens, the Bureau of Land Management is considering taking 90,000 acres from Texas residents.
When Thomas Jefferson purchased the Louisiana Territory in 1803, it established the border between Texas and Louisiana to be the bans of the Red River. Like many other rivers, periodically, the Red River will shift its course due to heavy rains and flooding. As the river shifts, Texas and Louisiana dispute the location of their mutual border.

When the river shifts south, the Texas Farm Bureau recognizes that as the official state border. When the river shifts back north, they insist that the border remain where it was. The dispute over the land has been going on for nearly two hundred years.

To settle the dispute, the BLM is seriously considering confiscating the land for themselves and this has Texas Attorney General Greg Abbott ready to take up arms to protect Texas land. Abbott commented about the issue, saying:
"I am about ready to go to the Red River and raise a 'Come and Take It' flag to tell the feds to stay out of Texas."

He has written a letter to Neil Kornze, Director of the BLM (who is also involved in the scandalous attempt to steal land from Nevada rancher Cliven Bundy). The letter reads in part:
"I am deeply concerned about the notion that the Bureau of Land Management believes the federal government has the authority to swoop in and take land that has been owned and cultivated by Texas landowners for generations,"

"The BLM's newly asserted claims to land along the Red River threaten to upset long-settled private property rights and undermine fundamental principles — including the rule of law — that form the foundation of our democracy. Yet, the BLM has failed to disclose either its full intentions or the legal justification for its proposed actions. Decisions of this magnitude must not be made inside a bureaucratic black box."

In a recent interview, Abbott said:
"What Barack Obama's BLM is doing is so out of bounds and so offensive that we should have quick and successful legal action if they dare attempt to tread on Texas land and take it from private property owners in this state."

"This is the latest line of attack by the Obama administration, where it seems like they have a complete disregard for the rule of law in this country. And now they've crossed the line quite literally by coming into the state of Texas and trying to claim Texas land as federal land. And, as the Attorney General of Texas, I am not going to allow this."

Abbott is one of my favorite Attorney Generals in the nation because he stands up for his people, laws of Texas and the Constitution. When New York Governor Andrew Cuomo began enacting some of the strictest gun control laws in the nation, Abbott ran ads in New York inviting gun owners to move to Texas. He also invited firearm companies to relocate from New York, Connecticut, Maryland and Colorado because Texas proudly upholds the Second Amendment.

He’s not afraid to stand up to the BLM or any other federal agency. He already went after the funding for Planned Parenthood and won, cutting off all state funds from the abortion provider.

Abbott is running for governor of Texas to replace the retiring Rick Perry. His Democratic opponent is Wendy Davis who has lied about her past, her experience with guns and more recently the gender wage gap. If I lived in Texas, not only would I vote for Abbott, I would have signs up in my yard and I would be telling everyone I know to vote for the only candidate who cares more about the people than themselves. In fact, I wouldn’t mind seeing him make a run for the White House in a few years down the road.

MILLIONS OF ACRES BEING STOLEN RIGHT NOW!!
We are in big trouble folks. There are unreported federal land grabs going on all over the country right now. Spread the word. It's time to stop sharing private and go public. STOP HIDING! You fail your country if you do.

The U.S. Army wants 418,000 acres of private ranch land to triple the size of its Piñon Canyon Maneuver Site, a training area considered suitable -- some would say essential -- for preparing American warriors to do battle in the Middle East and Afghanistan. The 1,000-square-mile facility would be 15 times the size of the District.

Several dozen ranchers and members of 15 county commissions that voted to oppose the project find themselves pitted against the Pentagon and Colorado business interests in a struggle over property rights, personal heritage and the contested priorities of national security.

Don’t let anyone tell you that this White River Watershed National Blueway isn’t a Federal land grab. The whole purpose of this Blueway is to take over ALL land and Surface Water. You need be be familiar with Agenda 21 and the Wildland project to understand the goals are to rewild over 50% of the United States.

Senator Jim DeMint took to the pages of the Washington Post this morning to raise the alarm about a planned, 10 million acre Western land grab by the Obama administration.
A secret administration memo has surfaced revealing plans for the federal government to seize more than 10 million acres from Montana to New Mexico, halting job- creating activities like ranching, forestry, mining and energy development. Worse, this land grab would dry up tax revenue that’s essential for funding schools, firehouses and community centers.
President Obama could enact the plans in this memo with just the stroke of a pen, without any input from the communities affected by it.

Kit and Sherry Laney are one of hundreds, perhaps thousands, of ranching families who are being squeezed off their land throughout the West. This case has the potential to erect a barrier to further expansion of federal land takeovers in the West or to erase the last hope of retaining ranching as a part of Western culture in the United States.

Both ranchers and federal officials are watching with great anxiety as the conflict moves toward resolution.

The Diamond Bar Ranch is at least 180,000 acres and includes some of the most beautiful land in southwest New Mexico, situated between and including portions of the http://www.wilderness.net/index.cfm?...eView&state=nm”>Gila and Aldo Leopold Wilderness areas.

Laney’s ancestors began the “Laney Cattle Company” there in 1883 when the area was still a territory. In those days, “prior appropriation” of water determined grazing rights to the land. That meant the first person to make beneficial use of water obtained the “rights” to the water and to the forage within an area necessary to utilize the available water.

The Great Land Grab: Rush for World’s Farmland Threatens Food Security for the Poor
The Oakland Institute sounds the alarm on the threat that land grabbing poses to food security and livelihoods. Land grabs--the purchase of vast tracts of land from poor, developing countries by wealthier, food-insecure nations and private investors--have become a widespread phenomenon, with foreign interests seeking or securing between 37 million and 49 million acres of farmland between 2006 and the middle of 2009.
