1 dead, 1 wounded as Stone Oak man thwarts burglary

A man was killed and another was shot in the chest early today in Stone Oak by a man who told police he caught the men breaking into his SUV.

Roger Pemberton, 25, said he heard noises outside a home at Lightstone Drive near Stonepath Drive — a few blocks northwest of Stone Oak Parkway and Hardy Oak Drive — about 1:50 a.m. Pemberton said he went outside and found the two men burglarizing the SUV, Officer Matthew Porter said.

Pemberton confronted one of the men as he sat in the SUV, then shot him twice in the chest when the man turned on him, Porter said.

Pemberton then fired at the second man twice as he tried to get away in a Dodge Neon. The man, 37, drove a short distance before he crashed into a parked vehicle.

He died at the scene.

Police said they didn't immediately know whether the men who were shot were armed, but Pemberton told officers the man in the SUV had something in his hand.

Officials declined to identify the 32-year-old man who was shot inside the SUV.The identity of the man killed is being withheld pending notification of relatives.

Porter said Pemberton — said by KENS-TV to be visiting family at the home — likely won't face charges.

“The victim was attempting to prevent the consequence of a theft,” Porter said. “That's why he confronted the suspects.”
