    Suspected Child Rapist Posts Bond, Leaves Country

    A suspected serial child rapist is out of jail and out of the country. He managed to post bond and was sent back to Mexico by Immigration and Customs Enforcement officials leaving his legal issues pending in Dallas. How was this able to happen, and what does this mean for his victims?

    The suspect - Jose Rico - reportedly targeted two young victims in the Five Points area of Dallas. Both lived in apartment complexes in the area, and now the fear is they may never see their day in court.

    An emotionally distraught aunt opened up to CBS11 in October when her 12-year old niece was reportedly sexually assaulted by 33-year old Jose Rico. Dallas Police say Rico entered the girl's apartment unit through an open door and proceeded to threaten and assault her. Investigators say DNA evidence also linked Rico to a similar assault just a few blocks away. The victim in that case is just 14-years old.

    "Normally our policy is when they post bail, we can't deny them," said Dallas County Sheriff's Detective Raul Reyna. "It's a constitutional right that they have."

    According to Reyna, officials with ICE picked up Rico from county custody to sent him to Mexico the same day. ICE officials say at the time, Rico had no active warrants.

    "If they deported him then he's in Mexico, and we can't get him," Reyna said.

    We've also learned that the day after Rico left the country, his bond was revoked.

    "The court has since held his bonds insufficient, so they reissued the arrest warrant," Reyna explained. "Once he reenters the country, the warrants will be active and he'll be arrested as soon as he tried to cross back in"

    Rico's attorney says he wasn't aware his client was deported, but says he's confident his client will return to the U.S. to face his charges. Meantime, we're told the district attorney's office is the only one with authority to raise a bond if there's fear an individual is a flight risk. That was not done in Rico's case. No one from their office returned our calls for comment.

    He will be back alright, but he will be using a different name in another part of the country. Just my opinion.
