Pylman: Utica officers back from Puerto Rico

    April 24, 2007
    By VANESSA EBBELING

UTICA — A suspect in the shooting death of Utica Police Officer Thomas Lindsey is scheduled to appear in Utica City Court next week on drug charges.

Sammy Rivera, 30, of Seymour Avenue, was scheduled to appear Monday, but his appearance was postponed one week because of a request from Rivera's attorney, Oneida County District Attorney Scott McNamara said.

Rivera was the driver of the Dodge Neon that Lindsey pulled over shortly before he was fatally shot on April 12. Rivera is being held in Oneida County jail on charges unrelated to the shooting.

Oneida County Chief Public Defender Frank Nebush Jr. said he could not comment on the reason the court appearance was rescheduled until Monday. McNamara also would not discuss the reason.

New developments Monday in the investigation into Lindsey's death included:

•Utica police officers have left Puerto Rico, where they questioned Jose Cirino, who police named as a suspect Saturday, and another person, Utica police Chief C. Allen Pylman said at a news conference Monday. A second person also was interviewed in Puerto Rico, but Pylman would not provide the name of that person. He said police learned of that person while in Puerto Rico. Both Cirino and the other individual were cooperative, he said, and neither have been charged or detained.

Cirino is believed to be a native of Puerto Rico, who frequently travels to Utica for business and family reasons. Police said he was in Utica on the day of the shooting.

•Pylman said it's possible Utica police could return to Puerto Rico, or Cirino could come to Utica at some point during the investigation.

•Cirino and the other individual questioned in Puerto Rico are connected in some way to Rivera, Pylman said, but police are still defining the nature of the relationships.

•Pylman emphasized he was not criticizing the Hispanic community at a news conference Saturday when he said some individuals had been uncooperative with police. Pylman was referring only to a specific group of people who police believe know more about the incident than they are revealing, he said.

"My point was to say there is a certain element of that community that are not being as cooperative as we would like," he said.
