Title: AN ACT TO REQUIRE STATE AGENCIES AND POLITICAL SUBDIVISIONS TO VERIFY THE LAWFUL PRESENCE IN THE UNITED STATES OF ANY PERSON WHO APPLIES FOR STATE, LOCAL OR FEDERAL PUBLIC BENEFITS; TO PROVIDE FOR CERTAIN EXCEPTIONS TO THIS REQUIREMENT FOR VERIFICATION; TO PROVIDE THAT APPLICANTS FOR PUBLIC BENEFITS MUST EXECUTE AN AFFIDAVIT THAT HE OR SHE IS A UNITED STATES CITIZEN OR IS A QUALIFIED ALIEN UNDER FEDERAL LAW AND IS LAWFULLY PRESENT IN THE UNITED STATES; TO PROVIDE FOR A CRIMINAL PENALTY FOR WILLFULLY MAKING A FALSE STATEMENT OF REPRESENTATION IN THE AFFIDAVIT REQUIRED BY THIS ACT; TO REQUIRE EACH STATE AGENCY AND POLITICAL SUBDIVISION THAT ADMINISTERS ANY PROGRAM OF STATE OR LOCAL PUBLIC BENEFITS TO PROVIDE AN ANNUAL REPORT TO THE ATTORNEY GENERAL WITH RESPECT TO ITS COMPLIANCE WITH THIS ACT; AND FOR RELATED PURPOSES.

AN ACT TO AMEND SECTION 37-106-29, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT MISSISSIPPI STUDENTS WHO HAVE AT LEAST A 3.0 GRADE POINT AVERAGE IN HIGH SCHOOL AND MAINTAIN THAT AVERAGE SHALL BE ELIGIBLE FOR A SCHOLARSHIP EQUAL TO THE FULL COST OF TUITION AT ANY STATE INSTITUTION OF HIGHER LEARNING OR PUBLIC COMMUNITY COLLEGE, REGARDLESS OF THE IMMIGRATION STATUS OF SUCH STUDENT; AND FOR RELATED PURPOSES.

SENATE BILL NO. 2255
To: Judiciary, Division A; Finance
AN ACT TO REQUIRE ENTITIES THAT TRANSMIT WIRE TRANSFERS TO COLLECT A FEE ON WIRE TRANSFERS TRANSMITTED TO LOCATIONS OUTSIDE THE UNITED STATES; TO REQUIRE THE FEES SO COLLECTED TO BE TRANSMITTED TO THE DEPARTMENT OF REVENUE NOT LATER THAT THE FIFTEENTH DAY OF THE MONTH FOLLOWING THE CLOSE OF EACH CALENDAR QUARTER; TO CREATE A SPECIAL FUND IN THE STATE TREASURY TO BE KNOWN AS THE BORDER FENCE FUND AND TO REQUIRE REVENUE COLLECTED AS A RESULT TO THE WIRE TRANSFER FEE TO BE DEPOSITED TO THE CREDIT OF THE FUND; TO PROVIDE THAT MONEY IN THE FUND SHALL BE USED FOR THE PURPOSE OF ASSISTING IN THE CONSTRUCTION OF A FENCE ALONG THE BORDER BETWEEN THE UNITED STATES AND MEXICO; TO PROVIDE THAT A TAXPAYER SHALL BE ALLOWED AN INCOME TAX CREDIT IN AN AMOUNT EQUAL TO THE WIRE TRANSFER FEES PAID BY THE TAXPAYER; AND FOR RELATED PURPOSES.

The version of illegal immigration legislation passed by the House on Thursday is tougher on businesses that hire illegal immigrations than the measure passed last week by the Senate, calling for fines of up to $25,000 per day for infractions.
The measure the House overwhelmingly stamped also removed controversial language from the Senate bill that county and city representatives said could open up mayors, aldermen, police officers and other officials to lawsuits brought by citizens who felt they weren’t doing enough to uphold the act.
Any fines collected from businesses would be returned to local municipalities to help in their efforts to enforce the act, such as with the hiring of additional law enforcement officers, said Rep. Bobby Moak, who presented the bill on the House floor.
Senate Bill 2179 passed the House with little discussion after a brief committee hearing Thursday afternoon. The Senate debated the bill for about four hours last week.
The chambers would have to reconcile their differences before it can be sent to the governor, who would have to sign it before the act becomes law.
The measure passed 80-36.

Immigration bill altered; Costs for verifying shifted to employers
House members kicked the "immigration football" across the Capitol's third floor Thursday by amending Senate legislation so employers of illegal immigrants, not local governments, will now bear the financial costs in determining immigration status.
Senators approved immigration legislation on Jan. 18 based on the Arizona law that empowers law enforcement officers to require drivers pulled over for traffic offenses prove they are in the country legally.
That raised the ire of local government officials, who said they would be saddled with the additional cost of investigating and housing illegal immigrants until they are taken into federal custody.
"There were some who were distressed at what they saw coming out of the Senate," said Rep. Bobby Moak, D-Bogue Chitto, a member of the Judiciary A Committee.
"We didn't think that local first responders were the problem in the legislation that came over from the Senate, so we addressed what we've been hearing from concerned Mississippians."
House members amended the Senate legislation, on a 77-40 vote, by placing the financial burden on all employers who hire illegal aliens.
