    Immigration - As introduced, requires all state and local governmental entities to verify that all employees hired after July 1, 2011, are not illegal aliens. - Amends TCA Title 12; Title 39 and Title 50.


    This bill requires all state and local governmental entities to verify that all employees hired after July 1, 2011, are not illegal aliens.

    Under present federal law, the department of homeland security provides an electronic work authorization verification service to all 50 states to verify the immigration status of potential employees.

    This bill prohibits a public employer, on or after August 1, 2011, from hiring any employee until the public employer verifies the employment eligibility of the employee by using such work authorization program. Also, a public employer must verify, on or before January 1, 2012, the work authorization status of all currently employed employees by using the work authorization program. If a current employee is not authorized to work according to the work authorization program, the employee may appeal the results of the work authorization program's findings. After such appeal, if the employee is still not authorized to work according to the work authorization program, then the public employer must immediately terminate the employment of the employee.

    This bill also prohibits any public employer from knowingly employing, recruiting or referring for a fee for employment an illegal alien. This bill requires the commissioner of labor and workforce development to conduct an investigation of a public employer if any state or local governmental agency, officer, employee or entity has reason to believe that a violation of this provision has occurred, and such agency, officer, employee or entity files a complaint with the department. Upon initiation of such investigation, the commissioner would inform the public employer against whom the complaint is made that the public employer may request the name of the person filing the complaint or the person who caused the complaint to be filed. The commissioner would provide the name of such person to the public employer if requested. If there is substantial evidence that a violation has occurred, the commissioner would conduct a contested case hearing pursuant to the Uniform Administrative Procedures Act. If the commissioner determines that there is clear and convincing evidence of the violation, then such public employer would immediately terminate the employment of the employee.

    Illegal aliens need to be identified without time of hire restricting the discovery of their illegal presence.

    Tennessee needs legislation to stop illegal aliens from getting business licenses in cities and counties. Penalties for employing illegal aliens, but illegal aliens can own and operate businesses and restaurants. These are loopholes that need to be closed. Tennessee Legislature members, including Reps. Tony Shipley, Eric Watson, Kevin Brooks, Senators Mike Bell, Bill Ketron, and others have been asked to address this. It does make you wonder if they want to cover all the bases when it comes to illegal aliens.
