An apparent illegal immigrant has been charged with Monday's shooting death of Huntsville police officer Daniel Golden.

Police charged Benito Albarran, 31, with capital murder Monday night, about six hours after Golden was gunned down in the parking lot of a Jordan Lane restaurant. Albarran is in the Madison County Detention Facility on Wheeler Avenue without bond.

Police Chief Rex Reynolds, flanked by police department senior administrators, said at a Tuesday afternoon news conference that he did not know Albarran's occupation.

Albarran had "fraudulent documents" on him, Reynolds said. The chief said police are assuming Albarran is in the country illegally because he did not have any documents to prove he is here legally.

Golden, a second-shift patrol officer in the west precinct, responded to a domestic call at Jalisco, a Mexican grocery and restaurant, at 2648 Jordan Lane about 3:20 p.m. Monday. Reynolds said the 911 call concerned a woman in distress. Reynolds did not know the relationship between Albarran and the woman, other than to say they "were together."

Golden apparently got out of his patrol car and was shot in the parking lot. Reynolds said Golden returned fire, but he did not know how many shots Golden fired. No one else was injured in the shooting.

Reynolds said he was waiting for the forensics report when asked how many times Golden was shot. He did say that from witnesses accounts, Golden was not shot after falling to the ground and he was wearing a bulletproof vest.

Reynolds said he did not know what kind of gun the shooter used, other than it was a pistol and police are tracing it.

Golden, 27, was rushed to Huntsville Hospital by ambulance. He died there a couple of hours later without ever regaining consciousness.

Police took several people at the scene into custody. Albarran was charged with capital murder about 9 p.m. Monday. No one else has been charged, but Reynolds said that if the investigation shows that anyone else knew what was going to happen, police will consider appropriate charges.

Albarran has not confessed to the shooting, Reynolds said.

Golden, a three-year veteran with the department, was the first Huntsville police officer to die in the line of duty since William T. Gaskin was shot to death while trying to make an arrest in 1968. In the city's bicentennial year, Golden became the eighth known city police officer to die in the line of duty.
