Today is Cinco de Mayo, and a display of American flags was organized near a high school in Morgan Hill, California, which was the site of controversy four years ago:

The case began in 2010, when four boys wearing t-shirts bearing American flags on Cinco de Mayo, when the school was decked out in Mexican flags, were told to turn the shirts inside-out, or go home.

Remembering that day, several people were waving American flags today at Live Oak High:

Students in a California school district will not be allowed to wear American flag T-shirts on Cinco de Mayo, due to concerns that such displays of patriotism would inflame racial tensions by offending Mexican students on their holiday.
The district’s policy concerned many free speech advocates, but was upheld by the Ninth Circuit Court of Appeals.
In response, Tea Party groups plan to protest outside Live Oak High School in Morgan Hill. And they will be wearing American flag T-shirts.

“They silenced a symbol of patriotism and freedom in America,” said Georgine Scott-Codiga, president of the Gillroy-Morgan Hill Patriots, in a statement to KCBS.
The trouble dates back to Cinco de Mayo in 2010, when the school forced four students to remove their American flag T-shirts. Administrators worried that fighting would break out between white and Latino students if the shirts were noticed, and so the four offending students were sent home.
The practice of limiting one group’s free speech rights because that speech might cause another group to react violently is known as the “heckler’s veto.” It is understood by free speech enthusiasts to have a chilling effect on First Amendment rights.

The Ninth Circuit, however, ruled in February that the school was legally permitted to abridge white students’ free speech rights in service of Latino students’ feelings.
The Tea Party protest is focused on the free speech issue, said Scott-Codiga.

Patriot Group Protests Cinco de Mayo Ban on American Flag T-Shirts

A protest against a California school district’s decision to ban the wearing of American flag t-shirts on Cinco de Mayo has begun this morning, with demonstrators displaying large flags and banners outside Live Oak High School in Morgan Hill.

The demonstration stems from an incident in 2010 when four students at the school were told by assistant principal Miguel Rodriguez to turn their shirts inside out or go home because the American flag designs were seen as “offensive” to Mexican students on Cinco de Mayo, a day on which Mexicans celebrate their heritage.

The incident led to a lawsuit, Dariano v. Morgan Hill Unified School District, in which students claimed their First Amendment rights had been violated. However, in February the 9th Circuit Court of Appeals sided with the school, asserting that the threat of racial violence as a result of the t-shirts trumped the right to free speech. The case is set to be heard by 11 judges after another appeal was filed.

A group calling itself the Gilroy-Morgan Hill Patriots arrived this morning to display large American flags outside the school as students arrived for classes.

“The school…. erected a temporary chain link fence, covered in mesh, so that no one can get in – or see into – the school campus. And on Monday, school leaders put up a giant green-and-gold poster that reads, “United at the Roots,” reports NBC Bay Area.

According to Freedom X, the organization representing the Gilroy-Morgan Hill Patriots, the local community has been hostile to the protest.

“The group’s plans are not being received well by members of the community who have threatened protests in order to disrupt the event,” states their website. “The Morgan Hill Unified School District has held public meetings where the Patriots have been derided as racists. The district’s superintendent, Steve Betando, has repeatedly urged the Patriots to cancel the event ostensibly for safety reasons. Yet when pressed to explain what safety issues he anticipates, he is unable to give a clear answer.”

The NBC report clearly skews the issue in favor of the school, without mentioning whether or not students would be allowed to wear t-shirts bearing the Mexican flag.

Dozens of protesters began arriving outside school gates before 7am and were greeted by honks of support from passing motorists.

That American citizens must fight to display an American flag in front of an American, tax payer supported, high school is sick beyond words. That other presumed citizens should oppose, insult and demean them is incredible.

Here patriots is the most positive proof that uncontrolled, government sanctioned, mass migration of foreigners is destructive to the country and our society.

We need a whole lot more protest to take back our country. Fight patriots. Never stop, never go away, give the enemy no rest. This is our country; it does not exist for the benefit of every foreigner who wants to come here to exploit our benevolence and loot our wealth. It does not exist for the benefit of RINO Republicans, or Marxists professors, or Zuckerberg or Silicon valley mega rich or the Chamber of Commerce or Obama and his Marxist junta. They are elitist who think the USA is their personal property to buy and sell and give away in pieces as rewards to their loyal serfs. This land is our legacy. It belongs to us. Patriots fight tooth and nail for what is yours by right, your heritage. FIGHT!

CA School Bans American Flag Clothing During Cinco De Mayo

We live in the Republic of the United States of America. A land that claims to be land of the free and home of the brave. Unfortunately, there are certain days when American students are not free and can be banned from being brave.

And before you say “this won’t pass the legality test” you may want to consider the fact that the Ninth Circuit Court of Appeals has upheld the policy as being legal. The Ninth Circuit Court of Appeals is considered one of the most activist federal appeals courts in the country and this absurd, anti-free speech decision confirms it.
As Daily Caller puts it, the federal courts created new protections for speech by one group by taking free speech away from another.

The Ninth Circuit, however, ruled in February that the school was legally permitted to abridge white students’ free speech rights in service of Latino students’ feelings.

Land of the free no more.

Despite raising a fence to keep out protesters, a group of about 30 people waving American flags showed up at Live Oak High School in the California community of Morgan Hill, the San Jose Mercury News reported Monday. Twitchy reported that a number of leftists decided the patriotic display of U.S. flags on American soil on Cinco de Mayo, however, constituted racism in a number of tweets, most of which are too profane to quote here directly.
"Shout out to the racist (expletive deleted) adults, so-called Patriots who are posted up at Live Oak HS in Morgan Hill protesting Cinco de Mayo," one person tweeted.
"Hey Folks in Morgan Hill. You have some racist neighbors," another person added.
Another person said he would always be proud of the Mexican flag, but never the U.S. flag. According to that Twitter user, those displaying the flag are racists.
According to the Mercury News, police provided "tight security" for students arriving at school Monday. CBS said the fence was erected after calls for demonstrations and counter-demonstrations. Rumors also spread that a group of motorcyclists would also appear.
"Usually when you put up a fence, it’s a barrier. And, we interpret it as a barrier to keep out the first amendment,” said Georgine Scott-Codiga, president of the Gilroy-Morgan Hill Patriots. “I don’t believe there’s any need in America to suppress a national symbol of patriotism and freedom."
But it seems that's exactly what some want to do. KRON reporter Will Tran, however, said in a tweet that according to the local school superintendent, students will not be kicked out for wearing an American flag.
The protest was sparked by an incident in 2010, when four boys wearing American flag t-shirts on Cinco de Mayo were told to turn the shirts inside-out, or go home. The school, meanwhile, was decked out in Mexican flags. A recent court case suggested student safety trumps the First Amendment right to free speech.
Police said Monday there were no counter-protests, and the flag-wavers were cooperative.
“Despite the contrary message that has been depicted, there will be no counter-protest. Both groups conducting demonstrations on Cinco de Mayo – Gilroy-Morgan Hill Patiots and We the People Morgan Hill – have worked cooperatively with law enforcement, the school district land each other," authorities said in a press release.

Four years ago the administrators at California’s Live Oak High School ordered students who wore patriotic American flag t-shirts on Cinco de Mayo to change or go home. Mexican flag apparel was not similarly ordered removed. They justified their move as a safety consideration, which a California court later ruled was legal.

The bitter taste of having the American flag removed from display to make room for Mexican flags on our own soil still hasn’t gone away and a group of about thirty protesters made that point outside Live Oak High on Monday, May 5^th.
