    Senate immigration bill offers Dreamers the best DREAM Act version yet

    After a decade-long battle to push for legislation that would legalize undocumented youth who’ve resided in the United States since they were children, the Senate immigration reform bill offers Dreamers the best DREAM Act version yet.
    The immigration reform bill crafted by the so-called “Gang of Eight” provides the vast majority of undocumented immigrants with a 13-year path to legal permanent residency if they learn English, pass a background check and pay back taxes, among other requirements. But the DREAM Act provision of the bill states that Dreamers wouldn’t have to wait that long to legalize their immigrant status.
    Instead, they would be put on a five-year path to legal permanent residency. That’s the fastest such track ever offered by any DREAM Act legislation. To qualify, Dreamers must meet certain requirements, including have been present in the U.S. since Dec. 31, 2011, entered the U.S. before the age of 16 and either graduated from a U.S. high school or obtained a GED.
    The immigration reform bill also excludes Dreamers from having to pay certain fees. Dreamers who were deported prior to 2012 and were deported for non-criminal reasons would be allowed to reenter the country under the bill.
    During the markup of the immigration reform bill, the Senate Judiciary Committee approved two new amendments that would directly benefit Dreamers. One of those amendments, proposed by Sen. Richard Blumenthal (D-Conn.), would allow Dreamers to enlist in the military and become citizens within one year of serving. Another one, filed by Sen. Mazie Hirono (D-Hawaii), would make Dreamers eligible for some student loans and federal work-study programs to help pay for college, except Pell Grants.
    New DREAM Act version is ‘testament’ of Dreamers’ advocacy work

    Cristina Jimenez, managing director of United We Dream, said the immigration reform bill’s language that would benefit Dreamers is “a testament to the power that United We Dream and Dreamers have built over 10 years of organizing and sharing our stories.”
    Dreamers have been advocating for legalization of immigrant youth since 2001 when Sen. Richard Durbin (D-Ill.) and Sen. Orrin Hatch (R-Utah) introduced the first version of the DREAM Act. Numerous attempts have been made to pass the legislation, which would pave a path to citizenship for undocumented youth, but none have been successful.
    However, the advocacy work of Dreamers — which has centered on encouraging undocumented youth to tell their stories — paid off last summer when President Barack Obama announced Dreamers would be protected from deportation and granted work permits under the new program dubbed Deferred Action for Childhood Arrivals.
    Many advocates say the deferred action program — coupled with the 2012 election — helped intensify the momentum for immigration reform. The growth in momentum could’ve also influenced the senators in the “Gang of Eight” to propose in their bill this new five-year path to legal permanent residency for Dreamers.
    The five-year path has received support even from opponents of the overall language of the immigration reform bill.
    “Those who came here at young ages are people who have the most compelling case, so in principle I think the way the bill deals with them in general is okay,” said Steven Camarota, director of research for the Center for Immigration Studies, a think tank that has been critical of the immigration reform bill.
    “There are a lot of other things to criticize of the bill, but I don’t think that providing legal status to those who came at young ages is a bad idea,” Camarota added. “Giving them citizenship rather than some kind of temporary status certainly doesn’t seem unreasonable to me either, so I’m not too much of a critic of that part.”
    DREAM Act in immigration reform bill doesn’t include age cap

    However, one part of the Senate immigration reform bill that Camarota disagrees with is the lack of age cap for those who would benefit from the bill’s DREAM Act provision.
    Past DREAM Act bills stated that only those who were under the age of 30 would qualify. But the DREAM Act provision included in the immigration reform bill doesn’t have an age cap. It only states that anyone who came to the U.S. before the age of 16 could benefit from it.
    Camarota said this part of the bill doesn’t sit well with opponents of immigration reform.
    “I do think that age caps have an important role to play because they tend to help deter fraud and they help make sure everyone is not eligible for it,” he told VOXXI. “I think that is a reasonable criticism of that provision.”
    Meanwhile, Jimenez of United We Dream said an age cap would’ve left out many Dreamers who entered the U.S. as children. One of those Dreamers is Julieta Garibay, a 32-year-old who came to the U.S. from Mexico when she was 12 years old. Garibay, a co-founder of United We Dream, wants to become a military nurse.
    Jimenez also recognized that the immigration reform bill being crafted in the House could include — or it could be amended to include — a provision that would add an age cap to the DREAM Act. The House bill could also lack some of the same provisions benefiting Dreamers that are included in the Senate bill. However, she said that in conversations with Republicans and Democrats, members of United We Dream have been pushing for the House bill to include the same language as the Senate bill.
    “The new standard now is the language that you see in the Senate bill,” Jimenez told VOXXI. “That’s our message to Republicans and Democrats in the House.”

    Sen. Sessions: Senate immigration bill will 'hammer working Americans'

    Sen. Jeff Sessions (R-Ala.) said Friday that the Senate immigration reform bill would “hammer working Americans.”
    Sessions, one of the immigration overhaul’s most strident critics, suggested the measure would prioritize foreign-born workers over people already in the U.S. struggling to find a job.


    “This is far, far too many low-skilled workers that are going to take jobs and pull down wages of people unemployed and underemployed right now,” Sessions, a senior member of the Senate Judiciary Committee, said on Fox Business. “It's really, really dangerous.”
    The Senate Judiciary panel cleared the immigration bill crafted by the so-called “Gang of Eight” this week by a bipartisan 13-5 vote, and its supporters hope to rack up 70 votes in the chamber.

    But Sen. Robert Menendez (D-N.J.), one of the Gang of Eight, said Friday that the vote doesn’t yet have 60 votes in the chamber. Sen. Orrin Hatch (Utah), another senior Republican on the Judiciary panel, voted for the measure in committee, but has said he might not back it on the Senate floor.

    In his Friday interview, Sessions stressed that the unions for the officers that guard the border opposed the immigration bill, and that the measure would be a huge burden on the American safety net.
    “We believe in immigration,” Sessions said. “All of us do. And we all believe that we need to make this legal system of immigration better. This bill just does not do it, and it can't pass in this form.”

    Key conservative groups like the Heritage Foundation are also deeply skeptical of the Senate immigration bill, but other prominent figures on the right, like Grover Norquist and Douglas Holtz-Eakin, back a comprehensive immigration reform.

    You can bet that they will be wheeling and dealing and twisting arms to make sure they get the votes. Menendez probably would like everyone to become complacent and shut up about it while they hatch a plan to get it through.

    Menendez Tries to Scare Immigration Activists

    On Friday, as Congress was preparing for a week-long recess, NJ Sen. Bob Menendez said supporters of the Senate Amnesty bill were short the 60 votes they needed for passage. The next two weeks are critical for both opponents and backers of the Gang of 8 legislation in the Senate. While the media has treated passage of the Senate bill as a foregone conclusion, opposition is growing. Menendez's remarks Friday are intended to galvanize supporters of amnesty into action.

    The Democrats hold 55 seats in the Senate. Including the 4 GOP negotiators on the amnesty bill would presumably leave supporters just one vote short of overcoming a possible filibuster. Menendez's comment suggests that not all Democrat Senators are assured of supporting the immigration bill.
    This week, two events gave new optimism to opponents of the bill. Early in the week, a broad coalition of conservative and tea party organizations announced their opposition to the Senate bill. The coalition promised to engage grass roots activists to defeat the Senate bill. Late in the week, meanwhile, House Speaker John Boehner and his leadership team announced that the House would do its own work to reform the immigration system and wouldn't consider a bill passed by the Senate.
    Importantly, Boehner was joined in his statement by VA Rep. Bob Goodlatte, Chair of the House Judiciary Committee. Goodlatte's committee will take the lead role on crafting immigration reform in the House. He is expected to move several individual pieces of legislation addressing the issue. Related talks on a comprehensive bill to reform immigration by a House version of the Senate's gang have stalled.
    When the Senate returns on June 3rd, it will resume work on a Farm Bill. It will likely take up immigration the following week. Momentum has moved slightly against the Senate amnesty bill. Menendez is hoping to mobilize supporters of amnesty to reverse this. Gang members have publicly stated they hope for 70 or more votes in support of the amnesty bill. Menendez is hoping to scare activists enough to help make that happen.

    Texas official: Obama playing politics with U.S. border

    Drug cartels are running rampant across the Texas border, and the federal government is doing little to impede the smuggling andviolence, says the Lone Star State’s Agriculture Commissioner, Todd Staples.
    Staples, who addressed the House Immigration Reform Caucus on border security and immigration issues last week, is one of a cavalcade of local officials and interested parties making their way to Washington, DC as the Senate considers the “Gang of Eight” omnibus immigration bill.

    But his advocacy for farmers and ranchers in Texas, he told The Daily Caller, gives Staples a special perspective on the immigration issue. Texans along the southern border, he said, feel like they’re living in a no-man’s land and must fend for themselves in the absence of federal enforcement.


    “The Constitution says it’s the federal government’s duty to protect against incursion from foreign invasion. I can’t think of a better way to describe this,” says Staples, who is running for lieutenant governor of Texas in 2014, largely on an immigration-reform platform. The state gets short shrift compared to California and Arizona, Staples said. “People have a right to defend themselves.”

    He’s not referring to groups like the Minutemen but to ranchers and farmers defending themselves against armed marauders. “What the federal government has done is create a situation in which it’s impossible for good men and women to tell the difference between thugs who want to do harm and illegal immigrants just looking for work.”
    In his book “Broken Border, Broken Promises,” Staples describes constituents who have gun battles with cartels, others who have fled hostile intruders and some who narrowly avoided kidnapping.

    Staples, whose department in 2011 ordered a “Strategic Military Assessment” of immigration from retired Army general and former drug czar Barry McCaffrey, says Washington needs to pay closer attention to links among South and Central American regimes, criminal networks and fanatical foreign powers. He advocates naming Mexican cartels as terrorist groups and adopting some of the military hardware now at play on the Afghan-Pakistan border along America’s southern border.“Military mobilization is not what I’m suggesting,” Staples said. “Just a commitment to security, but we have to have the will. Unfortunately, it’s not evident in this administration.”

    Rather than militarizing the border, the Obama Administration is doing the opposite, politicizing it, said Staples. He pointed to President Barack Obama’s battle with Arizona Governor Jan Brewer over SB 1070 [pdf], a state law that required state and local police to during traffic stops and other lawful contact, provided they have reasonable suspicion that the person is an illegal.

    Obama’s Justice Department contended to the Supreme Court that immigration responsibilities fall solely within the purview of the Feds, but Staples argues, “It just doesn’t make any sense for the government under this administration to say it has absolute authority over border and immigration policy and then assume little of it.”
    Staples, a former state representative and senator from the Palestine area between Houston and Dallas, believes the Obama administration wants to ease up on immigration enforcement for political reasons. “It’s called ‘Battleground Texas.’ That’s the Democrats’ plan to turn Texas into a Democrat stronghold, so Republicans will never win another national election,” he said.


    “Democrats are interested in voters, not workers,” Staples said. “The labor unions calling the shots don’t want that kind of competition. What we get instead is neither security, nor a workforce, but government dependency for a whole new swath of people Democrats will muster at election time.”Staples supports a guest worker program as an immigration solution but does not want it to come with an automatic path to citizenship either. He said the GOP on Capitol Hill is falling into a political trap by talking simply of security and amnesty.

    Reid Says He'll Easily Get the 60 Votes to Pass Immigration Bill

    Senate Majority Leader Harry Reid says it will be "pretty easy" to get the 60 votes needed to pass the Senate's immigration overhaul legislation, which would mark a significant milestone for one of the president's top initiatives.

    "I think we have 60 votes," the Nevada Democrat said in an interview for the television program "To the Point," according to The Las Vegas Sun.

    "Remember, we start out at 55 Democrats. I think the most I'll lose is two or three. Let's say I wind up with 52 Democrats. I only need eight Republicans, and I already have four, so that should be pretty easy."

    The bipartisan bill passed the Senate Judiciary Committee with a number of amendments last week. Reid, who has the authority to determine the order of legislation, told reporters last week the measure is the first item on his agenda after the farm bill, which is currently pending, according to Roll Call.

    Nevada Sen. Dean Heller is one Republican who recently signaled his intention to vote for the immigration measure.

    "In order for immigration reform legislation to be successful, it must continue through Congress with an open process. These past several weeks, I have been able to work with Sen. Marco Rubio, R-Fla., and other senators involved in this important bill, and we are finding ways to make this legislation even better," he wrote Sunday in an op-ed piece carried in The Las Vegas Review-Journal.

    "I am hopeful that this same pattern of transparency and openness will continue as members debate the legislation on the Senate floor."
