    Problem with that states don't have the authority to form a militia along the border or control the local national guard UNLESS they declare war from invasion. They have the Constitutional right to do so and they very well could and it would be technically legal except for the fact the courts are filled with wanna be bench legislaturers rather then actual law reading judges.

    However IF the military was used in that manner as they can't garner the full potential of the US Military it would be a basic put soldiers on the border. (Mod Edit/rule violation, RB)

    Real hairy situation and to do it properly using the US Military really need the full capability of the US Military and the budget that goes with it to set up the proper defenses.

    The border won't be erased and Obama wouldn't win that fight. That would be one of the few things that would cause civil war in the US and I highly doubt the Military would stay on his side as he would have betrayed his oath and them betraying their oath of protecting from all agressors both foreign and domestic.

    The most controversial of those laws has been SB1070, the first in the United States to criminalize the presence in the country of people "without papers."
    This is wrong. If the person is in the country legally but doesn't have "papers" with him/her it is not an offense. If the person is not in the country legally it is a misdemeanor unless there are also other specific offenses.

    All I know offhand is right now its Federal Law all immigrants are required to carry their papers on them at all times. Of course its an ignored one but it is the law.
