US seeks to deport Kilmar Abrego Garcia to Uganda after he refused plea offer in his smuggling caseWe’d really rather not go through the whole trial thing, stick him in jail and have to pay for that, and then deport him. Because the end result will always be deportation. I guess he could say “I’m going back to El Salvador, OK?” and go. His wife and kid can go with him. His lawyer is whining about Gangbang Kilmar doesn’t speak the language in Uganda, so, El Salvador, right?
Immigration officials said they intend to deport Kilmar Abrego Garcia to Uganda after he declined an offer to be sent to Costa Rica in exchange for remaining in jail and pleading guilty to human smuggling charges, his defense attorneys told a court Saturday.
The Costa Rica offer came late Thursday and included a requirement that he remain in jail for the time being and then serve whatever sentence he would receive for pleading guilty, according to a brief filed in Tennessee, where the criminal case was brought. After Abrego Garcia left jail on Friday, Immigration and Customs Enforcement notified his attorneys that he would be deported to Uganda and should report to immigration authorities on Monday.
Later on Friday, “the government informed Mr. Abrego that he has until first thing Monday morning — precisely when he must report to ICE’s Baltimore Field Office — to accept a plea in exchange for deportation to Costa Rica, or else that offer will be off the table forever,” his defense attorneys wrote. Justice Department spokesperson Chad Gilmartin responded to the brief with a statement saying, “A federal grand jury has charged Abrego Garcia with serious federal crimes … underscoring the clear danger this defendant presents to the community. This defendant can plead guilty and accept responsibility or stand trial before a jury. Either way, we will hold Abrego Garcia accountable and protect the American people.”

The judge’s order allows the US to do this, as long as they provided notice so the wife-beater’s lawyers can challenge. And, then he goes on trial and put in jail and then deported.

The move comes just days after Abrego Garcia was released from federal custody in Tennessee, where he had been held since June on human smuggling charges. Prosecutors allege he made hundreds of trips ferrying illegal aliens across the southern border before being caught in a 2022 traffic stop.

Really, at this point, why not simply put him through standard deportation proceedings for Kilmar? Shouldn’t take long. He’s here illegally. That’s all that’s necessary. Goodness, there has already been a final deportation order in 2019Kilmar Abrego Garcia taken into ICE custody, but judge blocks deportation for nowSo, just show he is illegally present in the U.S. per Federal Code 8 and deport his ass back to El Salvador. Or, he could choose another country. Regardless, he has to go.
Kilmar Abrego Garcia, who reunited with his family last week after 160 days apart following his mistaken deportation to El Salvador, was taken into ICE custody Monday after an immigration check-in, but a judge later ruled that he cannot be deported, for now. (snip)
Abrego filed a new lawsuit in U.S. District Court in Maryland “seeking to ensure that he is not removed from the United States pending his immigration proceedings.”
The lawsuit asked a federal judge to issue an order that Abrego not be allowed to be removed from the United States unless he is given proper due process to fight his potential deportation.
The suit challenges Abrego’s deportation to Uganda or any other country unless and until he has had a fair trial, Sandoval-Moshenberg said. He later argued that deporting his client to any country without any credible assurances that he could stay there would be “just a very inconvenient layover to El Salvador.”
At a hearing Monday afternoon, U.S. District Judge Paula Xinis ordered that Abrego must remain stay detained in the United States — temporarily blocking his deportation to Uganda — until she holds an evidentiary hearing.
Before his ICE check-in appointment and detainment Monday morning, Abrego addressed reporters surrounded by family, supporters, faith leaders and his legal team, who were all calling for his freedom.Did you get that?
“My name is Kilmar Abrego Garcia, and I want you to remember this, remember that I am free and I was able to be reunited with my family,” he said in Spanish before a translator repeated in English.

So…Are we supposed to ignore that the Democrats are claiming Trump can’t send Kilmar Abrego Garcia to Africa because he can’t speak the language but Kilmer needs a Spanish to English interpreter to give his speech while in America? Weird!?

“Maryland Man’s” Lawyer Wants Immigration Case Reopened So He Can Declare Asylum

This is a joke, right?Abrego Garcia’s attorneys ask to reopen his immigration case to seek asylumUm, he didn’t voluntarily show up at the border declaring asylum: the government brought him back to face charges for felony human trafficking. Members of gangs are not eligible for asylum. Nor are wife beaters. It’s an interesting attempt by his lawyers, though, they have to throw everything at the wall.
Abrego Garcia, who was rearrested Monday in Maryland after he was released Friday from criminal custody in Tennessee, is currently being held in a detention center in Virginia, where the federal government is temporarily blocked from deporting him pending further proceedings in a habeas case.
“At 5pm yesterday, Petitioner filed a motion to reopen before an immigration judge to seek asylum in the United States,” his attorneys said in a proposed scheduling order filed on Tuesday. “Petitioner proposes that the parties allow the immigration judge to resolve that motion within two weeks from today.”
According to the emergency motion to reopen the case, his attorneys argue that because Abrego Garcia was deported and then brought back to the U.S., he is now eligible to apply for asylum within one year of his last entry into the U.S.
The motion asks the immigration court in Baltimore to “immediately” order a stay of removal to afford Abrego Garcia “an opportunity to seek protection from persecution and torture in Uganda,” where the government has indicated he could be sent.
“Respondent fears persecution and torture in Uganda because he is a Salvadoran national and would be a deportee without any legal status in Uganda,” his attorney said in the filing. “Furthermore, he is at risk of being removed to El Salvador by the Ugandan government where he is likely to once again face persecution and torture within CECOT.”He can go anywhere he wants, as long as it is outside the U.S.
In the filing, the attorney also said that reopening the case is warranted to allow Abrego Garcia to designate Costa Rica as the country of removal.Just say “Put me on a plane to Costa Rica. I’m outa here” and they’ll send you. Because, otherwise, the government is going to prosecute him and stick him in jail for quite some time for trafficking, and then deport him once released. Of course, I fully expect some wacko judge to rule in his asylum claim, because that’s what they seem to do. Which will then be overturned by a non-wacko court.
It’s still amazing, even knowing the Democratic Party, how much they are willing to defend this guy.
