    How does the federal government deport aliens?
    The Immigration and Naturalization Service (INS) and the Executive Office for Immigration Review (EOIR) are separate agencies within the Department of Justice (DOJ). Both are responsible for the removal of illegal aliens and criminal aliens residents from the United States. The INS has the responsibility of apprehending and bringing immigration charges against aliens. The EOIR consists of the nationwide United States Immigration Court system and its appellate component, the Board of Immigration Appeals (BIA) in Falls Church, Virginia. In Immigration Court proceedings, the INS plays the role of the prosecuting agency, while the Immigration Judges of the EOIR play the role of judge. Cases are appealed to the eighteen-member BIA, and then to the federal circuit courts of appeal. The process of seeing one illegal alien or criminal resident alien through Immigration Court hearings and the two-stage appeal process frequently lasts years, prolonging any final decision on deportation. As the EOIR bureaucracy busies itself with this process, the aliens (who were supposedly facing deportation) remain in the United States living their lives. Though the idea behind the hearing and appeal process was apparently for illegal aliens to be given "due process" before being deported, the end result is a system that only prolongs the stay of illegal aliens and criminal alien residents in the United States. This system is broken. It needs to be streamlined in order for the United States to be able to control its immigration. Moving the INS into the newly-created Department of Homeland Security, while the EOIR remains intact in the Department of Justice, does little to eliminate the deportation abyss of federal immigration bureaucracy.

    How can the EOIR be abolished?
    It's up to Congress. The Executive Office for Immigration Review, as an agency of the Department of Justice, was created through legislation. Now that Congress already abolished the INS, why not go ahead and scrap the EOIR litigation bureaucracy once and for all?

    How could the BIA be abolished?
    It's up to the Attorney General. The Board of Immigration Appeals (BIA) was created as a creature of regulation. The Attorney General could modify the Code of Federal Regulations, 8 C.F.R. Section 3.1 to be exact, and eliminate the redundant appellate component of the EOIR completely. The Attorney General already stopped the BIA's expansion in its tracks in Feburuary, 2002. Why not finish the job, Mr. Ashcroft?

    What do the immigration judges do?
    The EOIR's immigration judges nationwide are responsible for determining whether illegal aliens and criminal alien residents are removable from the United States. The country's over 200 EOIR immigration judges earn from $103,840 to $136,476 per year. They preside over EOIR Immigration Court hearings called "removal proceedings" under Section 240 of the Immigration and Nationality Act. But with so many ways available for aliens to avoid actually being removed, these "removal" proceedings really should be called "get to stay" proceedings. Getting aliens to stay in the United States winds up being the primary focus of this bureaucratic exercise. After the INS apprehends the aliens, reviews their immigration status, and serves the alien with a "Notice to Appear" in removal proceedings, the immigration judge reviews the charges again to see if the alien is deportable. The charges are based on the alien committing criminal activity or violating the terms of legal immigration status. If the immigration judge finds that the INS has presented "clear and convincing evidence" that the alien is removable from the United States, the immigration judge will issue an order of removal. But that is just the beginning of a process where the alien wins just by being in it, because of the inherent delay, delay, delay of the system.

    How do aliens avoid being deported in Immigration Court?
    If the immigration judge finds that the INS has not met its burden of burden of proof by "clear and convincing evidence," then the case is terminated, and the alien is free to disappear back into the United States. But if the alien is found removable, the alien can apply from a laundry list of relief from removal contained in the Immigration and Nationality Act (INA) in order to prevent being issued an order of deportation. That's why "removal" proceedings really should be called "get to stay" proceedings. Here's the proof. The laundry list of legal ways that aliens can avoid being ordered deported by the EOIR's Immigration Court (note that any denial of these benefits can be appealed through the BIA and federal courts in order to postpone any actual departure from the United States):

    Who else could do all the work if the EOIR and the Immigration Court system is abolished?
    There are thousands of federal government employees around the country and at United States consulates abroad who already perform the same functions as the employees of the EOIR. They already do the same jobs in a fraction of the time, without the ridiculous bureaucratic delay of endless hearings and appeals, and at a fraction of the cost of EOIR's government lawyers in black robes. Here's who is already doing the EOIR's job or could do it better in a heartbeat:

    INS District Adjudications Officers (examiners) – adjustment of status, derivative citizenship claims, inadmissibility waivers INS Asylum Officer Corps – political asylum, withholding of removal, U.N. Convention Against Torture INS Special Agents (investigators) – administrative removal, criminal alien apprehension INS Deportation Officers – administrative removal, criminal alien removal U.S. Border Patrol Agents – administrative removal, Section 235(b) determinations INS Immigration Inspectors – expedited removal, Section 235(b) determinations INS District Directors – waivers, registry, humanitarian parole
    INS District Counsels – provide legal advice to determine whether aliens are removable U.S. consular officers abroad – all immigrant and non-immigrant visa processing, political asylum, refugee petitions, U.S. citizenship determinations Relief that should be abolished – all stealth amnesty provisions that reward law-breaking; including Section 245(i) adjustments, and non-permanent resident cancellation of removal under Section 240A(b).

    What happens if someone gets deported who wasn't supposed to be deported?
    The bottom line is that deportation is not a criminal sentence for prison time or the death penalty. If the alien was "wrongfully" deported, all the alien would have to do is ask to come back in again! Any foreign national has the potential of showing up at a United States consulate in any country of the world, or showing up at a United States land border at any time to make an application for admission. If the alien claims to be a United States citizen, that claim could be heard. Our immigration inspectors and consular officers make decisions as to who should be admitted to the United States every day of the year. We already trust them to make these determinations. If aliens believe that a mistake was made, all the alien has to do is reapply for admission! It's as simple as that.

    What is an Immigration Bond?
    INS District Directors throughout the country set the custody conditions for aliens detained for Immigration Court proceedings. But these decisions are immediately reviewed and second-guessed by EOIR immigration judges throughout the country in Immigration Court. The Immigration Judges can turn around and release just about any alien where the INS sets a bond, except the most serious criminal aliens. The BIA then can review the rulings of their fellow EOIR employees, the immigration judges. After that, the circuit courts of appeal can review the decisions of the BIA, making a federal case out of the detention bond amount for every single alien detained by the INS. With this system in place, it is no wonder that the INS actually detains so few aliens, compared to the staggering amount of illegal aliens and criminal resident aliens in this country. So while the Immigration Court proceedings go on and on, with all the needless delay that EOIR bureaucrats can muster, aliens released from INS custody continue their illegal and criminal presence in this country.

    Why is detention, detention, detention so important?
    If the United States actually is going to deport illegal aliens and criminal alien residents, the aliens need to be detained throughout the deportation process. Period. If the aliens are not kept in INS custody, there is no guarantee that the government will ever see them again -- regardless of the outcome of their Immigration Court case. The deportation system of the EOIR is broken. If the INS continues to catch and release aliens as they are entering the country for the first time, the charade of EOIR Immigration Court hearings actually creates new illegal aliens every day. As long as the process is focused on litigation bureaucracy, rather than on detention and deportation, the EOIR process will remain open for business as an institutionalized amnesty machine.

    Thanks for directing us to this website.

    I was just thinking the other day, “We have many groups on our side of the immigration issue, but we are not as untied as LaRaza, Mechea (spelling?) and other Hispanic rights groups. Hell! In Chicago alone there must be six or seven supports groups. And they all link or have ties back to LaRaza.

    Like I said, we have just as many, maybe even more, but we need to more united. The two main ones ALIPAC and NumbersUSA seem to have cross members, but where else can we add to our head count. I know they are out there, but where?

    Dose anyone else know of other websites with links?

    How a community treats the illegals is key as to how many come there. The main magnet is the establishment of a day labor center. The nation-wide illegal network knows where to send them. If a community opens its arms, of course they flock there. If a community stands up to them, they leave.

    On the local level too, there is great pressure on elected officials to do nothing. Many immigrant groups are joined together through the La Raza movement. These are the groups which organized the massive demonstrations in cities across the nation last year. It is past time for all Americans to know what is at the root of those demonstrations and the extent to which our nation is at risk to the La Raza movement.

    One of the most prominent Hispanic organizations pushing for "illegal and legal immigrant rights" is the National Council of La Raza - the Council of "the Race." The mainstream media and most members of Congress depict La Raza as little more than a Hispanic Rotary Club. In 2005, La Raza received $15.2 million in federal grants, of which $7.9 million was in U.S. Department of Education grants for Charter Schools, and undisclosed amounts to get-out-the-vote efforts supporting La Raza political positions including lobbying for open borders and amnesty for illegals. Had the Senate's immigration bill passed, several million more dollars were budgeted for La Raza.

    Behind the respectable front of the National Council of La Raza lies the real agenda of the La Raza movement. This radical agenda, pushed by secondary groups contains the reasons behind the demonstrations and the strong lobbying efforts in our communities.

    Key among those secondary groups is the radical racist group Movimiento Estudiantil Chicano de Aztlan, or Chicano Student Movement of Astlan (MEChA). MEChA seeks to carve a racist nation out of the American West. MEChA opposes assimilation into American society. MEChA is a leader in the effort to "Reconquista" or reconquest our western states.

    MEChA's founding principles state: "In the spirit of a new people that is conscious not only of its proud historical heritage but also of the brutal gringo invasion of our territories, we, the Chicano inhabitants and civilizers of the northern land of Aztlan from whence came our forefathers, reclaiming the land of their birth and consecrating the determination of our people of the sun, declare that the call of our blood is our power, our responsibility, and our inevitable destiny... Aztlan belongs to those who plant the seeds, water the fields, and gather the crops and no to the foreign Europeans... For La Raza to do. Fuera de la Raza nada." That closing two-sentence motto is chilling to everyone who values equal rights for all. It says: "For The Race everything. Outside The Race, nothing."

    These words don't come from a fringe radical element. These come straight from the official MEChA sites at Georgetown University, the University of Texas, UCLA, University of Michigan, University of Oregon, and many other colleges and universities around the country.

    Another leading Hispanic group involved in community organization, promoting the pro illegal position is Mexicanos Sin Fronteras. The translation of the name means "Mexicans Without Borders." This group is active throughout the country and many times works with the "Zapatista Army of National Liberation." These groups seek to radicalize the Latino community. The official website of the Mexicanos Sin Fronteras states that it is "anti-capitalist, anti-imperialist in the capital of the most terrorist country of world-wide history" (Washington, DC). It goes on to say it pledges its support to "other campaigns" of the radical illegal Hispanics with material and financial assistance.

    In Manassas, Virginia the Mexicanos Sin Fronteras and the Zapatista Army of National Liberation are the two most prominent "pro-Hispanic" voices. In fact, these two groups are spearheading the illegal alien lobby in Prince William County, where Manassas is located. This is the "mainstream opposition" to efforts to curb illegal immigration in that community. Together, these groups are holding rallies and calling for boycotts and even the violent overthrow of the United States. Again, these groups are not fringe radicals. They are the most prominent voices for the illegals.

    Further, , there are several candidates running for local office as well as the state legislature who are closely aligned with these two radical organizations.

    While Congress fiddles and the Bush Administration issues meaningless pronouncements on "get tough" programs it never intends to enforce, local communities and state legislatures are beginning to fight back. And they are meeting with success.

    State Legislatures, forced to deal with the failure of the federal government to fix the immigration laws, have considered 1,404 immigration bills this year and enacted 170 of them. These laws are aimed at curbing employment of illegals and making it more difficult to obtain state identification documents like driver's licenses.

    In May, Oklahoma passed the "Taxpayer and Citizen protection Act" which denies illegals state identification, and requires all state and local agencies to verify citizenship status of all applicants before authorizing benefits.

    On the local level incredible success is being achieved in Northern Virginia. Last year two residents of Herndon, Virginia, with no prior political experience, began an effort called Save Herndon. The issue was the establishment of a day labor center in the community. The center would give illegals a gathering place in the community to help them get jobs, identification and benefits from the community.

    The two began a campaign that at once made a major issue out of the establishment of the center. When the mayor and the city council moved forward and voted to establish the center over the objections of a majority of the citizens, Save Herndon began a campaign to assure these representatives were not re-elected. They succeeded beyond their wildest expectations, helping to out the mayor and everyone on the city council who voted for the center.

    Now the movement is growing across the Northern Virginia area. There is now Help Save Manassas, Help Save Loudoun (County), Help Save Fairfax, Help Save Virginia and Help Save Maryland. Together these purely grassroots movements have succeeded in enacting legislation in Loudoun County (the nation's fastest growing county) and in its neighbor, Prince William County which stops county tax-payer services to illegals. Incredibly, under challenge from federal and state officials, the members of county commissioners are holding tough behind the laws.

    The key, as stated earlier, is the day labor centers. If your city has one, then the message has gone out to the illegal infrastructure that your community welcomes them. Get rid of it and send the message that they are no longer welcome. If faced with lawsuits from the ACLU and La Raze, welcome them. Tell them you will gladly have a news conference to discuss their suit in front of the cameras. Do not be afraid.

    Here are a few guidelines to help organize locally and face the coming onslaught of charges of racism. DON'T express anger at what is happening to your community. DON'T express annoyance because illegals refuse to assimilate into your community or abide by your customs. DON'T make the issue economic and safety issues. Overcrowded housing and commercial vehicle zoning violations or that specific individuals are illegal aliens.

    The pro-illegals will try to tell the public that there is uncertainty as to who is illegal, creating doubt. They will talk about how impossible it is to check everyone's legal status. It will be easy to charge racism.

    Instead, make the issues about the abrogation of law. Focus your efforts against the individuals, businesses and politicians who create this problem and cheat honest business owners and workers by allowing illegal hiring practices under the table. In short, make the issue about enforcement of the law, cost and corruption. It's working in Virginia.

    Today, we have the chance to not only stop the flood of illegal aliens, but in the process, deflate the size and power of the federal government in the process. It's time to organize Help Save America.

    Delta, this looks to be new article just published today. If so, you should post this in the News Forum so everyone can see it. There may not be many of the entire ALIPAC universe visiting this specific thread.

    Very Timely and needed article, the system is worthless in protecting Americans from invasion.

    When we were asked to call ICE during the Simi Chruch protest, I was told by the operator, it would take 3-6 months, for a federal investigation into Lilliani's case and before that they could not act on deporting her!
