A new Census Bureau report reveals that about 100,000 more people are leaving California than are coming to the state. Robert Kleinhenz, chief economist at the Los Angeles Economic Development Corporation says, "we're moving in the right direction" when it comes to adding jobs in California. When that happens, he says the migration numbers will likely turn around. Conan Nolan reports from Downtown LA for the NBC4 News at 5 p.m. on December 10, 2012.

About 100,000 more people moved away from California in 2011 than relocated to the Golden State, according to the latest report from the U.S. Census Bureau.

The trend can be explained, in part, in monetary terms. Even in an economic boom, the cost of living in California has increased, prompting people to move out, and, in recent years, unemployment in the state has skyrocketed.

So, where are these former Californians going?

The Census Bureau calculates that the most popular destination is Texas (58,992), a state that is luring California companies. That’s followed by Arizona (49,635), Nevada (40,114), Washington (38,421) and Oregon (34,214).

Although in smaller numbers, people are still relocating to the Golden State.

Texans make up the largest number of translates to California with 37,387 people, according to the report. That is followed by people from Washington (36,481), Nevada (36,159), Arizona (35,650), and New York (25,269).

Economic experts are optimistic that California’s economy has started picking up steam, and may reverse the movement out of the state.

“We expect over the next couple of years that we will add jobs,” said Robert Kleinhenz, chief economist with the Los Angeles County Economic Development Corporation. "This year, we’ve added jobs in California at a faster pace than in the nation as a whole. So, we are moving in right direction. As that happens, we’ll see the migration numbers turn around some."

Unconstitutional Proposition 30 Ready to Make California the Highest Taxed State

On Election Day 2012 the voters in California voted for an increase in sales tax, and a massive increase in State Income Tax on the wealthiest in the State. The claim was that the money was needed for education, but in reality it is going to be used to help pay for rising pension costs. The unions are powerful in California, and ensured that Proposition 30 passed, and Proposition 32, which would have limited how unions fund their favorite politicians, failed.

In Britain, two-thirds of the top earners fled the country after the tax rate against them hit 50%. The resulting unintended consequence was a UK £7 billion loss in revenue. When the United Kingdom announced they would reduce that rate to 45%, 10,000 millionaires returned.

In France, when the Socialists decided to raise the tax rate to 75% on income above 1.0 million euros per year, along with a sharp increase in taxes on capital gains from the sales of stock and company stakes, the rich began to leave the country. The successful population in France argues that the progressive tax rate will kill the market for innovative start-up companies. As in Britain, the French could be seeing a massive drop in revenue.

The Founding Fathers were aware of the dangers of this kind of taxation. They were against direct taxation, and called the concept of the redistribution of wealth a “Utopian scheme of leveling.” Samuel Adams went so far as to say such actions are, “Impractical, despotic, and unconstitutional” at the federal level.

Though direct taxation is constitutional at the State level, California’s hike in the tax rate against the rich is also retroactive to last January, and that makes the new law unconstitutional.

Article I, Section 10 of the U.S. Constitution says that “No State shall pass any ex post facto law.” Ex post facto law is retroactive law. As per Article I, Section 9, the federal government can’t pass any ex post facto law, either. That makes Proposition 30, and Bill Clinton’s retroactive tax in the 1990s, unconstitutional.

The new nation wanted to be nothing like the British they had won their independence from, and the monarchy played games with taxation, and ex post facto laws, to hang on to power, and tighten its grip on the people. The way the founders saw it, if congress applied laws ex post facto, people could be charged with crimes that they committed before the act itself was even illegal, and that was just not acceptable in a free country. That, in the opinions of the Founding Fathers, is tyranny, and so the Constitution is specific about no allowing ex post facto laws.

The unconstitutionality of Proposition 30 goes even deeper than that, however. In addition to the fact that retroactive law is unconstitutional, so is targeting a specific group and treating them differently under the law. Those that normally oppose the government following the original intent of the U.S. Constitution love to use the “Equal Protection Clause” in the 14th Amendment to support their talking points, but conveniently forget all about the Constitutional Requirement that all people be treated equally under the law when it comes to taxing the rich. Shouldn’t taxation, like any other law, be applied equally to all citizens? Is it not un-American to single out a single group with punitive laws?

In the end, California’s Proposition 30 is unconstitutional, which makes it an illegal law, and once implemented will cost California the revenue the ruling elite in Sacramento believes the new tax law will create when the wealthiest Californians leave the State, just as the richest folks did in France and Britain.

Prediction?

California is in for a tough economic ride, worse than she has already faced under liberal democrat leadership; and after the next census California will lose at least one representative in Congress due to the dwindling population. . . well, the State will lose that seat as long as the census-takers don’t count the illegal aliens as a part of the “legal” population.

Personally, I don't hate California, but I think that the liberal policies are running a great State into the ground and won't change their ways. This is a logical reaction of smart people who live in California and unfortunately sees that every day there are more possibilities in all aspects for illegal aliens than for American citizens. Liberals and Unions are destroying California. Smart people don't want to see the total destruction.

But instead your FEDERAL government is, right now, giving green cards and social security cards to millions of DREAMERS. And next year your FEDERAL government is going to give green cards and social security cards to the dreamers parents, grand parents and other relatives. The FEDERAL government has already given citizenship to all of the anchor babies.

The government of California is on the leading edge for giving benefits to illegals at the expense of California tax payers. I couldn't agree more that Federal government has failed to do it's job and enforce our laws.

JD- as long as I am a tax paying, voting resident in this state I WILL whine and complain about it! It's my right and when our life situation changes, I too, will be taking my tax paying ass outta here after we cash out on our two houses. I have to say I envy you for being so happy and satisfied where you live - I really wish I did. I also envy anyone who is older than me at this point. Never thought I'd feel that way but I sure have lately. Just have not found the "hill I want to die on" (as my dad says) yet, but I hope to one day.

I wish I could I up and leave, but I have family obligations with two kids in elementary and middle school and a spouse with a job that, in all honesty, used to be great pay, but now just "gets us by" and he is at the top of his pay scale. With the rising costs of everything here, I have little faith that this will suffice for us much longer since we have little and no money for anything extra. It's really scary.

People here are so stressed out. The feeling is palpable.

On Breitbart.com; they reported that California Tax Revenue Plunges by 22% “State Controller John Chaing continues to uphold the California Great Seal Motto of “Eureka”, i.e., 'I have found it'. But what Chaing is finding as Controller is that California’s economy as measured by tax revenues is still tanking. Compared to last year, State tax collections for February shriveled by $1.2 billion or 22%.

The deterioration is more than double the shocking $535 million reported decline for last month. The cumulative fiscal year decline is $6.1 billion or down 11% versus this period in 2011.

While California Governor Brown promises strong economic growth is just around the corner, Chaing proves that the best way for Sacramento politicians to hurt the economy and thereby generate lower tax revenue, is to have the highest tax rates in the nation.

California politicians seem delusional in their continued delusion that high taxes have not savaged the State’s economy. Each month’s disappointment is written off as due to some one-time event.

The State Controller’s office did acknowledge that higher than normal tax refunds for February might have reduced the collection of some personal income taxes. Given that 2012 has an extra day in February for leap year, there might have been one day more of tax refunds sent out.

But the Controller’s report shows personal income tax collections fell by $325 million, or 16% versus last year. Furthermore, leap year would have added another day for retail sales and use tax collection, but those revenues also fell during February-by an even larger $813 million, 25% decline from 2011.

The more likely reason tax collections continue falling is that businesses and successful people are leaving California for the better tax rates available in more pro-business states.

Derisively referred to as “Taxifornia” by the independent Pacific Research Institute, California wins the booby prize for the highest personal income taxes in the nation and higher sales tax rates than all but four other states. Though Californians benefit from Proposition 13 restrictions on how much their property tax can increase in one year, the state still has the worst state tax burden in the U.S.

Spectrum Locations Consultants recorded 254 California companies moved some or all of their work and jobs out of state in 2011, 26% more than in 2010 and five times as many as in 2009.

According SLC President, Joe Vranich: the “top ten reasons companies are leaving California: 1) Poor rankings in surveys 2) More adversarial toward business 3) Uncontrollable public spending 4) Unfriendly business climate 5) Provable savings elsewhere 6) Most expensive business locations 7) Unfriendly legal environment for business Worst regulatory burden 9) Severe tax treatment 10) Unprecedented energy costs.

Vranich considers California the worst state in the nation to locate a business and Los Angeles is considered the worst city to start a business. Leaving Los Angeles for another surrounding county can save businesses 20% of costs. Leaving the state for Texas can save up to 40% of costs.

This probably explains why California lost 120,000 jobs last year and Texas gained 130,000 jobs.

California Governor Jerry Brown’s answer to the State’s failing economy and crumbling tax revenue is to place a $6 billion tax increase initiative on the ballot to support K-12 public schools. He promises to only “temporarily” raise personal income rates by 25% on any of the rich folk who haven’t already left.

Recent statewide poll show that support for the measure has fallen from 72% to 52% of likely voters since January. Democrats favor the tax increase by 71%, while Republicans are opposed it by 65%.

But independent voter support is now down to only 49% favoring versus 41% opposed as these swing voters begin to learn the initiative also raises their sales taxes, and the initiative will also be available to fund public safety realignment and freeing up dollars for "other spending commitments."

According to Chaing, California has plenty of “other spending commitments”:

“The State ended last fiscal year with a cash deficit of $8.2 billion. The combined current-year cash deficit stands at $21.6 billion. Those deficits are being covered with $15.2 billion of internal borrowing (temporary loans from special funds) and $6.4 billion of external borrowing.”

The rust belt cities have taken a huge hit during the last decade as industry leaves and people flee for better opportunities. The crashing of cities like Cleveland and Cincinnati have slid under the radar of Detroit’s epic fall. Even mighty Chicago has lost 200,000 residents.

What is even worse for these cities is they all have huge public works infrastructures that are driving taxes even higher as their populace flees. Most of the cities are highly unionized in both the public and private sector so there is very little flexibility to improvise and improve their lot.

Instead, they watch their mobile, productive citizens flee and are left trying to keep the cities moving forward.

Sixteen of Rhode Island’s 32 cities and towns lost residents, according to data from the 2010 census. Middletown and Newport experienced the greatest population declines, with each losing 6.8 percent of its citizens.

Rhode Island and Vermont are the only two states that have seen significant decreases in population in the past year.

Hispanics in N.C.: Big numbers in small towns

In 2000, Hispanic/Latinos accounted for only 4.71 percent of the N.C. population. By 2010 the percentage was 8.39, making the state's rate of Hispanic growth sixth-fastest in the nation. The latest data show that trend is continuing, with the Hispanic population growing from 8.39 to 8.6 percent from 2010 to 2011.* This continuing increase in Hispanic population has been an important part of growth in urban areas in the state – but Hispanics aren’t the only group contributing to the increase in those cities’ population. For a number of smaller towns, however, the recent growth of Hispanic population has made the difference between growth and decline.

North Carolina's Hispanic population is a little more than half the percentage in of the U.S. overall (16 percent for the U.S compared to 8.39 percent in North Carolina in 2010). However, many towns across the state meet or exceed the U.S. percentage. North Carolina's average percentage of Hispanic population is highest in a set of small and medium-sized towns scattered around the state. The map below shows the Hispanic/Latino population percentage among North Carolina’s cities and towns in 2010.

Of the largest cities, Winston-Salem had the highest Hispanic population in 2010 with 14.7 percent. Nearby Greensboro was the largest city in the state to be below the N.C. average, at 7.5 percent. Charlotte (13 percent) and Durham (14.2 percent) are similar to Winston-Salem. Raleigh was also above the state average at 11.4 percent. Several larger suburban communities like Huntersville, Mooresville and Cary are below the state average, as are Asheville and Wilmington. Cities and towns in northeastern North Carolina contain the fewest Hispanic residents.

The second map labels all towns across the state that have a population that’s more than 20 percent Hispanic.

Robbins, in northern Moore County, and Siler City in western Chatham County are approximately 50 percent Hispanic. Asheboro (26.9 percent), Monroe (29.4 percent) and Sanford (25.6 percent) are the largest towns in the state with Hispanic populations of more than 20 percent. Several towns with populations less than 1,000 have Hispanic populations of around 40 percent.

http://www.alipac.us/sites/default/f...spCitiesLG.jpgSiler City, in the heart of some of the highest-percentage Hispanic towns in the state, is an example of an impact also elsewhere: With a population of 6,966 in 2000, the town had grown to 7,887 by 2010. The Hispanic population grew from a little less than 40 percent in 2000 to nearly 50 percent in 2010.

Owen Furuseth, associate provost for Metropolitan Studies and Extended Academic Programs at UNC Charlotte, has done extensive work on the topic of community change associated with Latino immigration. He made several observations about the geographic distribution seen here:
What is striking to me about the data are two broad patterns. First, the highest percentages of Hispanics are overly represented in small towns and cities across the state. From the foothills to the coastal plain, Hispanics are an important ethnic group in rural places. And, I suspect without Hispanic in-migration many of these small towns would be emptying out, losing population. Hispanics play an important role in many economic needs of rural N.C. statewide.

Two, Hispanics are urban North Carolinians. The largest number of Hispanics live in the largest cities in the state. They are increasingly moving from rural to urban areas, or moving to cities from other states or international locations.

Why? Greater economic opportunities, higher quality of life issues and joining friends and family.

Late in the 20th century, Hispanics were concentrated in rural North Carolina. Today, they are a part of urban and suburban North Carolina.
