class action law suit?
CLASS ACTION LAW SUIT
against law makers and law enforcers.

NEGLIGENCE IN LAW;
“Actionable negligence” or “negligence in law” grows out of nonobservance of a duty prescribed by law.
Can American citizens, who have been harmed by illegal immigrants because immigration laws have not been enforced by those whose responsibility is to enforce those laws, bring a class action law suit against them for damages cause by their not doing their jobs and enforcing immigration laws?
Every American citizen who work and pay taxes have been harmed. Every child, senior citizen and the poor who have to share social services and schools with illegals have been harmed. Including those who have been harmed my criminal acts by illegals.
All other laws are stringently enforced except immigration laws. Even trivial laws like those against jay walkers, parking, disturbing the peace, tatoos, etc are enforced.

Just wondering. There has got to be some way the government would be held responsible. Voting those responsible in and out of office is not working. I just think we are losing our fight against illegal immigration.

I am not the only one thinking of a class action suit.

We start a group LLC, funded it by its members and then began using the law like “they” do. We will sue them personally and then we will sue the actual agencies that do not enforce the laws. We can call this LLC (group)

Have politicians no accountability for there actions other than losing the next election cycle. There has to be more than that.
If i fear no repurcussions in my job other than mabey having to find another heck I might hazard most anything dont you think?
in this present day of political correctness the moral majority is afraid of saying anything to anyone because we will be the one demonized. We will be the one labeled and ostersized by the media and the ACLU. Will we the rest of Americans continue taking this laying down. Are you not tired? Are you not fed up?
Are you like me and for years you have been saying someone needs to do something!! Let us americans4america say YES..then lets take action..let us take our country back..not with violence but with what we have given to us the same things being used AGAINST us. Our laws, our constitution and our bill of rights. Did our founding fathers imagine our media and our politicians turning on the legal population like this?
Of course not. Nut we can act we can do something….we can
1. sue (it is easier than passing a law) laws are already on the books lets make them enforce them or leave!!
2. march and demand action
3. garner media attention
4. place adds in newspapers and magazines
5. talk to everyone you know
6. wear teashirts and hats
7. put bumper stickers on your vehicle8. have town hall meetings
9. Let the American people know by whatever peacefull
means that they have been betrayed and we expect
our elected leaders to enforce the laws or they will be
sued and removed from office for dereliction of duty
and treason against the American people!!
10. campaign and help elect Americans that uphold the
law!!! (like Pat Buchanan and tom Tancredo)

Any lawsuit against the federal government has to be made under the Federal Tort Claims Act. Read through the act and then we'll get back to why you can't successfully sue the federal government in a class action of the nature you describe.

I'll even help you out a bit by providing an excerpt of an article that discusses the operative exception to the government's waiver of tort immunity that applies in the sort of case you propose:
Congress did not categorically waive sovereign immunity in the FTCA. The act contains thirteen exceptions, which release the federal government from any liability for enforcing unconstitutional statutes, for losing letters in the post office, for actions of the military in time of war, for damages caused by the fiscal operations of the Treasury Department or regulation of the monetary system, for collecting custom duties, for claims arising in a foreign country, for most intentional torts, and for several other miscellaneous kinds of claims (28 U.S.C.A. § 2680).
The most important and troublesome exception has been the discretionary function exception. Difficulty quickly emerged with the FTCA's provision that the waiver of immunity does not apply to any claim "based upon the exercise or performance or the failure to exercise or perform a discretionary function or duty on the part of a federal agency or an employee of the Government, whether or not the discretion involved be abused" (28 U.S.C. § 2680(a)). In Dalehite v. United States, 346 U.S. 15, 73 S. Ct. 956, 97 L. Ed. 1427 (1953), the U.S. Supreme Court broadly interpreted the discretionary function exception to include all situations involving the formulation or execution of plans that were drawn at a high level of government and that entailed exercise of judgment.
